CHaP. 414.—An ACT to amend the road law of Floyd county.
Approved February 25, 1992.
1. Be it enacted by the general assembly of Virginia,
That the road law of Floyd county be amended so as tocon-
tain the following provisions in addition to the law now
in force in said county:
2. It shall be the duty of each supervisor to keep him-
self informed as to the condition of the public roads and
bridges in his magisterial district, the manner in which
they are worked and kept in repair, and whether or not
the surveyors of their several precincts have fully per-
formed ther duty; and for that purpose each supervisor
shall inspect all the roads and bridges in his magisterial
district at least once in every six months, and make a re-
port in writing thereon to the county court of said county
once in every six months at such term thereof as the court
may prescribe, and the time for making such reports may
be changed in the discretion of the court. Said report
shall state the condition of each road precinct in the su-
pervisor’s district, designating each precinct by its num-
ber and giving the name of the surveyor.
3. For the inspection and report required by the preced-
ing section, each supervisor, in addition to what is allowed
him by law for other services, shall receive two dollars per
day for the time during which he is actually so employed,
not exceeding, however, the sum of thirty dollars for any
one year, to be paid out of the county levy.
4. If a supervisor of any district be unable to complete
such inspection and report, the same shall be made or com-
pleted by some other supervisor of said county, who shall
receive the compensation which would otherwise have been
received by the supervisor of such district, or a fair pro-
portion thereof.
5. The county court may, in its discretion, at the March
term of said court, or at the next term after appointment,
require the surveyor of each road precinct to enter into a
bond, with approved security, in a penalty of not more
than fifty dollars, conditioned for the faithful performance
of his duties as surveyor.
6. Every surveyor of a road shall be entitled to com-
pensation, at the discretion of the court, to be by it certi-
fied to the board of supervisors and paid out of the county
levy, not exceeding one dollar and fifty cents per day for
time actually employed in summoning the hands to work
on the road, and not to exceed one doll#r and fifty cents
per day for time actually employed in working the same,
which time shall be stated in writing and sworn to by the
surveyor, and the time actually employed in working
shall also be sworn to by one of the hands of said sur-
veyor’s road. If it appear from the report of the super-
visor, a8 required by the first section of this act, that the
road of any surveyor is not in the condition required by
section one thousand and seven of the code, the court may
refuse to pay such surveyor until the road is put in the
condition required by said section. A surveyor of a road
who fails to perform any duty required of him by this
act or by chapter forty-three of the code, shall for such
failure be fined not less than five nor more than thirty
dollars, which is intended to be covered by the official
bond of said surveyor, if one be required; and the report
of the supervisor, as required by the first section of this
act, shall be sufficient evidence on which to begin such
rosecution. Section one thousand and twelve of the code
is hereby repealed as to Floyd county, in case this act is
put in force as hereinafter provided.
7. So much of chapter forty-three of the code of Vir-
ginia as is in conflict with this act is hereby repealed, so
far as it applies to Floyd county, but in every other re-
spect the general road law of the state, as set forth in
said chapter, shall continue in force in said county of
Floyd.
8. The provisions of this act shall not be in force in
the said county of Floyd except and until the same is
adopted by the board of supervisors of said county; and
the said board of supervisors are hereby authorized and
empowered to adopt, by a two-thirds vote of that body at
any regular meeting of the board, the provisions of this
act as a part and addition to the road law of said county.
9. This act shall be in force from its passage.
