ington county.

1. Be it enacted by the general assembly of Virginia,
That John W. Gardner be, and he is hereby, relieved and
discharged from the payment of all of a fine of one hun.
dred and twenty-five dollars in excess of five dollars im.
posed by the county court of Washington county for the
failure to provide his mill-dam with a McDonald fishway :
provided, however, that the said John W. Gardner shal
pay all the costs attending the prosecution.

2. This act shall be in force from its passage.
