CHAP. 37.—An ACT to amend and re-enact the first and eleventh
sections of an act approved February fourth, eighteen hundred
and ninety, entitled an act to incorporate the Georgetown and
Falls Church railway company, and to extend the time for
the commencement of the construction of the road therein
mentioned.

1. Be it enacted by the general assembly of Virginia,
That sections one and eleven, of chapter one hundred and
fifty-five, of the acts of the general assembly, session of
eighteen hundred and eighty-nine and ninety, entitled an
act to incorporate the Georgetown and Falls Church rail-
way company, approved February fourth, eighteen hun-
dred and ninety, be amended and re-enacted so as to read
as follows:
§ 1. That George T. Dunlop, James M. Love, W. S.
Smoot and R. W. Moore, of Virginia; Samuel E. Wheat-
ley, William A. Gordon, Edward Derrick and Henry E.
Davis, of the District of Columbia, and such other per-
sons as may hereafter be associated with them, and their
successors be, and they hereby are, constituted a body
politic and corporate, by the name and style of the
‘Georgetown and Falls Church railway company,” with
all the rights, powers and privileges conferred, and sub-
ject to all the liabilities and obligations imposed by law
in respect of chartered companies in this state, except as
in this act hereinafter provided.
8 11. Said company shall begin the construction of its
road not later than April first, eighteen hundred and
ninety-four, and shall, within five years after so begin-
ning, have its road completed and in operation over its
entire route; and if that be so done, then this act shall
be forever operative, otherwise it shall, as to the unfin-
ished portion of said road, be and become null and void:
provided, however, that nothing herein contained shall ex-
empt said company from liability to the forfeiture of its
corporate franchises by reason of non-uses or other viola-
tion of law involving such forfeiture. |
2. This act shall be in force from its passage.
