Chap. 362.—An ACT to amend and re-enact sections 1, 5, 14 and
81 of an act entitled ‘‘An act to provide for the opening, alter-
ing, changing, and workin fe public roads of ison

1. Be it enacted by the genera] assembly of Virginia,
That sections one, five, fourteen, and thirty-one of an act
entitled “An act to provide for the opening, altering,
changing, and working the public roads of Madison
county,” approved February twenty-second, eighteen hun-
dred and ninety, be amended and re-enacted so as to read
as follows:
§ 1. Be it enacted by the general assembly of Virginia,
That the county court of Madison county shall, at its A pril
term, eighteen hundred and ninety-two, and every four
years thereafter, appoint three road commissioners for
said county; and in making said appointments the said
court shall appoint one commissioner from each magiste-
rial district inthe said county. The said commissioners
shall hold office for a term of four years from the first day
of May next succeeding their appointment, with duties
and powers, and subject to the provisions hereinafter con-
tained.
8 5. The said commissioners shall qualify at the term of
court at which they are appointed, and shall give bond,
with security in a penalty of not less than one thousand
dollars nor more than three thousand dollars, for the faith-
ful , performance of their duties as commissioners of

§ 14. Between the first and thirteenth of April and Sep-
tember of each year the commissioner shall pass over and
inspect every section of road in his district, and if any
road or section is not in good order, or has not ‘been worked
according to contract, said commissioner shall at once no-
tify the contractor of the fact, and if he does not within
twenty days from the notice put the section in such repair
as his contract calls for, then the commissioner shal] have
said road worked according to the terms of the contract,
and the cost of such work, including two dollars per day
for said commissioner while attending the same, together
with the costs of recovery, and an additiona] sum of ten
dollars per mile, or portion thereof, shall be recoverable of
the delinquent contractor on his bond by the commissioner
before a justice of the peace of the district, without limit
as to the amount, with the right of appeal to the county
court if the amount recovered exceeds twenty dollars. The
amount recovered shall, except costs, be paid to the treas-
urer of the county, to be by him credited to the road fund
of the district,
§ 31. The commissioner shall receive as compensation
one hundred dollars per annum, to be allowed by the
board of supervisors out of the county levy as other allow-
ances are made.
2. This act shall be in force from its passage.
