CHAP. 335.—An ACT authorizing the removal of the jail of Nor-
folk county and the city of Portsmouth and the sale of the pres-
ent jail property.

Whereas the council of the city of Portsmouth and the
board of supervisors of Norfolk county having unanimously
adopted resolutions looking to the removal of the jail
jointly owned by said city and county from its present
location at the southeast corner of High and Washington
streets, in said city, to a more eligible point in said city,
for the reason that the same is now improperly located
and is insufficient for proper jail purposes, and for this
purpose have entered, or are about to enter, into an agree-
ment touching such removal; therefore,
1. Be it enacted by the general assembly of Virginia,
That the council of the city of Portsmouth and the board
of supervisors of Norfolk county be, and they are hereby,
authorized to sell, publicly or privately, as they may deem
best, the present jail property, situate at the southeast
corner of High and Washington streets in said city, upon
such terms as may be agreed upon between them, or, in
lieu thereof, the said board of supervisors are authorized
and empowered to convey by proper deed executed by the
chairman of said board and under the seal of said county,
attested by the county clerk, tothe city of Portsmouth the
county’s one-half interest in said jail property, upon such
terms and conditions as have or may hereafter be agreed
upon between the said council and board of supervisors.
2. And be it further enacted, That the city of Ports-
mouth, through its council, be, and it is hereby, authorized
to convey to the county of Norfolk, for its purposes as a
jail, such portion of the new jail to be erected by the said
city on a lot recently purchased for that purpose at the
northwest corner of Water and County streets, in said
city, and upon such terms and conditions as have or may
hereafter be agreed upon between said council and board.
3. Should the said council and board of supervisors fail
to agree upon the terms of sale, or the terms and condi-
tions of conveyance as is hereinbefore provided for, then,
and in that event, either of said parties may by petition
apply to the circuit court of said city or county for a de-
cree of sale of said property at the corner of High and
Washington streets, and upon its appearing to the court
that the present jailis a nuisance, or is improperly located
in said city, or is insufficient for proper jail purposes, the
said court shall decree a sale of said property, at public
or private sale, upon such terms as it may deem proper
under the circumstances.
4. This act shall be in force from its passage.
