CHAP. 326.—An ACT to authorize the town of Rocky Mount to
borrow a sum of money not exceeding four thousand five hun-
dred dollars to pay damages for the right of way of the Roanoke
and Southern railroad from Waidsboro to Magodee Gap and to
levy a tax for the same.

Be it enacted by the general assembly of Virginia,
That the council of the town of Rocky Mount be, and it 1s
hereby, authorized to borrow a sum of money not exceed-
ing four thousand five hundred dollars, by bonding the
town of Rocky Mount for that amount, the money so bor-
rowed to be used in paying the damages for the right of
way of the Roanoke and Southern railroad from Waidsboro
to Magodee Gap, for which certain citizens of the town of
Rocky Mount are liable, as in discharging the liabilities
of the persons who have paid said damage.
2. That after the voters of said town, according to the
requirements of the general law and of the charter of the
Lown, shall have voted for the issue of the bonds necessary
fo raise the said amount of four thousand five hundred
dollars, that the town of Rocky Mount be, and it 1s hereby,
2uthorized, through its council, to issue bonds not exceed-
ing four thousand five hundred dollars, for the purpose
aforesaid, in such forms, running for such length of time
in such sums, payable at such periods and places, and
bearing such rate of interest, not exceeding six per centum,
as said council may determine.
3. That the council of said town of Rocky Mount be, and
it is hereby, authorized to carry out in every respect the
wishes of the voters of the town when expressed by a vote
for the issue of the bonds aforesaid, and to levy, assess and
collect such an annual tax as may be necessary to pay the
interest on said bonds and to create a sinking fund to pay
the principal of the same when they shall become due, the
limitation of the amount of taxation as prescribed in sec-
tion twelve hundred and forty-three of the code of Vir-
ginia of eighteen hundred and eighty-seven to the con-
trary notwithstanding.
4. If any authority is needed to empower the voters of
said town to vote on the question of the making of the
loan and of the issue of the bonds aforesaid, for the pur-
poses aforesaid, the same is hereby given.
5. This act shall take effect from its passage.
