CHAP. 253.—An ACT to incorporate the town of Shendun, Vir-
nia.
Approved February 16, 1892.
1. Be it enacted by the general assembly of Virginia,
That the territory contained within the limits set forth
and described in section second of this act be deemed and
taken as the town of Shendun, and the inhabitants of the
town of Shendun, for all purposes for which towns are in-
corporated in this commonwealth, shall be a body politic,
in fact and in name, under the style and denomination of
the town of Shendun, and as such shall have, exercise, and
enjoy all the rights, immunities, powers, and privileges,
and be subject to all the duties and obligations incumbent
upon and pertaining to said town as a municipal corpora-
tion.
2. The boundaries of the said town shall be as follows,
namely: Beginning at the northeastern corner of the vil-
la-lot portion of Shendun, the intersection of the northern
line of Shendun Pass street with the eastern line of the
alley lying east of Gloucester street; thence in a souther-
ly direction along the east side of said alley to the south-
ern side of E street; thence westwardly along said side of
E street to the right of way of the Norfolk and Western
railroad; thence northerly along said right of way to the
line dividing the tract recently owned by Mary E. Craw-
ford from the tract now owned by the Grottoes of the Shen-
andoah company; thence westwardly along said last men-
tioned line to the middle of South river; thence down
the middle thread of said river and following the main
channel thereof to a point where the eastern line of Sev-
enth avenue, produced in a northerly direction, intersects
said channel; thence southerly along the east side of
Seventh avenue, produced to the business portion of Shen-
dun, a corner of lot eighteen in block one hundred and
sixty-three; thence along the northern side of the busi-
ness portion of Shendun, passing along the northern side
of blocks one hundred and thirty-six, one hundred and
nine, eighty-two, fifty-five, a part of twenty-eight, and
thence between lots five and six in block twenty-eight to
the right of way of the Norfolk and Western railroad ;
thence along the western side of said right of way toa
point where the northern line of the property of the Mid-
dle Shendun land company, if extended westwardly,
would intersect said right of way, thence crossing the rail-
road to a corner of middle Shendun; thence along the lines
of Middle Shendun, south seventy-three degrees and
thirty-nine and three-fourths minutes, east seven hundred
and fifty-seven and one-tenth feet; thence north twenty-
three degrees and nine minutes, east thirteen and four-
tenths feet; thence south fifty-nine degrees and fifty-nine
and three-fourths minutes, east eight hundred and eighty-
two and two-tenths feet ; thence north twenty-three degrees
and two and one-fourth minutes, west seven hundred and
seventy-four and nine-tenths feet; thence north fifty-eight
degrees and eighteen and one- half minutes, west one hun-
dred and ninety-one and twenty-five hundredths feet;
thence south twenty-two degrees and thirty and one-half
minutes, west sixteen hundred and sixty and forty-five
hundredths feet to the southeastern corner of Middle
Shendun; thence continuing in the same direction to
Shendun Pass street; thence eastwardly along the north-
ern side of said street tothe point of beginning: The
greater portion of said territory lies in the county of
Rockingham, possibly a very small portion thereof lying
in Augusta county, the boundary line at this point not
being accurately fixed. The streets and alleys mentioned
in the above description are shown on maps of the prop-
erty of the Grottoes company, known as the map of the
villa lot portion and the map of the business portion of
Shendun, Virginia, and are duly recorded in the clerk’s
office of the county courts of Rockingham county and
Augusta county.
3. The government of said town shall be vested in a
council of seven, to be elected by ballot on the fourth
Thursday in May, eighteen hundred and ninety-three, and
every two years thereafter.
4. Any person entitled to vote in the state of Virginia,
and residing in the corporate limits of the town of Shen-
dun thirty day previous to any election, shall be entitled
to vote at all elections under this act of incorporation.
5. The following named persons are hereby appointed
to fill the following offices until the first day of July,
eighteen hundred and ninety-three, and until their suc-
cessors are elected and qualified, namely: W. J. Harns-
berger, mayor; and councilmen as follows: J. W. Rum-
ple, H. G. Miller, L. D. Patterson, J. M. Pirkey, E. K. Ar-
mentrout and J. G. Hall. The said council, which in-
cludes the mayor as presdent thereof, shall have power to
appoint a sergeant, treasurer, commissioner of the reve-
nue, and such other officers as may be necessary, who shall
remain in office until their successors are elected and
qualified. In case the council shall determine to have a
treasurer, sergeant, commissioner of the revenue, clerk,
or any of said officers, they, as well as the mayor and
councilmen, shall be elected by the qualified voters of
said town on the fourth Thursday of May, eighteen hun-
dred and ninety-three, their term of office to begin on
the first day of July following, and said officers shall be
elected bi-ennially thereafter.
6. The mayor and councilmen shall qualify by taking
the oath of office before any person qualified to administer
oaths, and if the mayor, or any of the above appointed
councilmen should fail to qualify for ten days after four
of those above appointed shall have qualified, they shall
be deemed to have declined said office, and those who
have qualified shall proceed to fill the vacancies thus ex-
isting. The above officers shall act without compensa-
tion, except that they may receive the fees allowed by
law for acting as justice of the peace in any case. The
mayor and each of the councilmen shall and may exer-
cise all jurisdiction, civil and criminal, conferred by law
upon justices of the peace, whether arising under the laws
of the state or under the by-laws and ordinances of the
council, within the corporate limits of the town of Shen-
dun, shall preserve peace and good order in said town;
and to this end, each one of them sball be a conservator
of the peace, with all the powers conferred upon conserv-
ators of the peace by law, and shall be entitled to the
same fees as justices of the peace, and each one of them
shall keep a record book as is required by law of justices
of the peace. Their jurisdiction when acting as justices
and conservators of the peace, in criminal matters, and
the jurisdiction of the corporate authorities of said town
in criminal matters and for imposing and collecting a
license tax on all shows, performances and exhibitions,
shall extend one mile beyond the corporate limits of said
town. Appeals from the decisions of said persons when
acting in capacity of justices of the peace, when allowed
by law, shall in all cases lie to the county court of Rock-
ingham county, and in no case to the county court of
Augusta county.
7. The sergeant of said town shall have the same pow-
ers, and discharge the same duties, as constables within
the corporate limits of said town, and to the distance of
one mile beyond the same. He shall have power to arrest
in said town or anywhere within Rockingham and Augusta
counties, upon a warrant issued by the mayor, a council-
man, or a justice of the peace, any person charged with a
violation of the laws of the commonwealth or ordinances
of said town; and where a violation of the laws or ordi-
nances aforesaid are committed in his presence, within the
limits of said town, he shall have authority and power,
without warrant, forthwith to arrest the offender, and car-
ry him before the mayor or some conservator of the peace
of said town, to be dealt with according tolaw. The coun-
cil may allow the sergeant a salary, and they may appoint
him as collector of taxes and levies, allowing him a cer-
tain per centum for collecting the same.
8. The person whose duty it may be to collect town
levies, taxes, and fines, shall have the same power to dis-
train therefor for goods and chattels within said town,
or within the counties of Augusta and Rockingham, as
tax collectors have in similar cases.
9. The council may impose a tax on the real and per-
sonal estate situated in the town of Shendun, but the said
tax shall not exceed fifty cents on the one hundred dollars
of the assessed value thereof; and the said council may,
by a resolution passed by two-thirds of the entire council,
exempt all land, machinery, implements, money, and cap-
ital actually used, by any manufacturing establishment
for manufacturing: purposes within said town from all
taxes for corporate purposes for a period of ten years from
July first, eighteen hundred and ninety-two, but this ex-
emption is not to be construed as applying to capital em-
ployed in purchasing articles manufactured outside of the
town and brought there to be used in manufacturing. The
council may also impose a license tax for the privilege of
doing any business within the corporate limits, the same
as now imposed by law in this state; and it may impose a
poll tax, not to exceed fifty cents per capita, on every male
inhabitant of said town over the age of twenty-one years.
But the said council shall not grant a license to any bar-
room, or for the sale of spirituous or malt liquors, unless
two-thirds of the members of the council shall vote there-
for, and in such case the license tax for keeping a bar-
room shall not be less than five hundred dollars, and for
selling liquor not to be drunk on the premises not less
than three hundred dollars per annum.
10. The council shall keep in order the public streets
and alleys and walks of said town, and it may require the
able-bodied male inhabitants over the age of sixteen years
to work on the same. The inhabitants of said town shall
not be required to work on the roads of the adjoining
counties, nor shall the real and personal property situated
in said town be subject to taxation for county road pur-
ses.
Yl 1. If the government of the said town is organized before
the first day of July, eighteen hundred and ninety-two, by
the qualification of the council, taxes assessed against real
and personal property, and the poll-tax, shall be regarded
as due for the whole of the year eighteen hundred and
ninety-two. Licenses shall follow the general law as to
apportionment from the time they may be imposed.
12. The boundaries of the said town shall be deemed to
constitute a lawful fence in all respects.
13. It shall not be lawful for the council to create a
debt, at any one time, in excess of twelve per cent. of the
assessed value of its real and personal property.
14. The said town shall be allowed the use of the Rock-
ingham county jail for the safe-keeping and confinement
of all persons who shall be sentenced to imprisonment
under the general laws or the ordinances of said town.
And when any judgment shall be rendered against a per-
son for any fine or penalty under any ordinance of said
town, and the same be not immediately paid, the person
or persons so in default may be required by the order of
the court passing sentence, to work out such fines or pen-
alties on the public streets or other public improvements
at fifty cents a day, under the direction of the sergeant,
and under such rules and regulations as may be deemed
proper by the council. °
15. This act shall be in force from its passage.
