CHAP. 217.—An ACT to amend and re-enact sections 1 and 8 of
an act approved February 25, 1890, entitled an act to incorporate
the Fincastle and Southern Botetourt development company.
Approved February 15, 1892.
1. Be it enacted by the general assembly of Virginia,
That sections one and eight of an act approved February
twenty-fifth, eighteen hundred and ninety, entitled “an
act to incorporate the Fincastle and Southern Botetourt
development company,” be amended and re-enacted so as
to read as follows: .
§ 1. Be it enacted by the general assembly of Virginia,
That William B. Simmons, C. M. Lunsford, C. B. Camper,
R. L. Houseman, Lewis Houseman, junior, Charles E. Lay-
man, Charles’H. Vines, J. H. H. Figgat, Turner McDow-
ell, E. J. Brugh, Cyrus Dogget, James Godwin, R. K.
Thompson, George Swann, I. A. Woodson, and John Ross,
or such of them as have accepted the provisions of the
act aforesaid, their associdtes, successors, and assignees,
be, and they are hereby, incorporated and made a body
politic and corporate under the name and style of the
Fincastle and Southern Botetourt development company,
and as such are authorized and empowered to locate, con-
struct, complete, equip, and operate a railroad line, com-
mencing at a point on or near the line of the Shenandoah
Valley railroad, at or near Cloverdale depot, or such other
point on said railroad as may be deemed most practicable,
in the county of Botetourt, running thence to a point
within or near the corporate limits of Fincastle, by such
route as may be deemed most advisable by the directors of
said company, and by that name shall be known; and the
said company shall have the right to operate their road
by the use of locomotive steam engines or dummy en-
gines in hauling freight cars and transporting passengers,
mail, and express traffic.
§ 8. The said company shall be required to commence
the construction of said railroad within two years, and to
complete the line to Fincastle, from the Shenandoah Val-
ley railroad, within five years from the passage of the act
to incorporate the said company, otherwise the powers,
privileges, and franchises hereby granted shall be ipso
facto void.
2. This act shall be in force from its passage.
