Chap. 166.—An ACT to amend and re-enact section 2844 of the
code of Virginia, as amended and re-enacted by an act entitled
an act to amend section 2844, of the code of Virginia, in relation
to public holidays, approved February 28, 1890, and to amend
and re-enact section 2847, of the code of Virginia.

1. Be it enacted by the general assembly of the state of
Virginia, That section twenty-eight hundred and forty-
four of the code of Virginia as amended and re-enacted by
an act entitled “an act to amend section twenty-eight
hundred and forty-four, of the code of Virginia, in relation
to public holidays,” approved February twenty-eighth,
eighteen hundred and ninety, and section twenty-eight
hundred and forty-seven, of the code of Virginia, be
amended and re-enacted so as to read as follows:
§ 2844. Public holidays.—When bills, notes, etc., other-
wise presentable on such holiday to be presentable-—The
first day of January, the nineteenth day of January (known
as Lee’s birthday), the twenty-second day of February,
the fourth day of July, the first Monday in September
(known as labor day), the twenty-fifth day of December,
and any day recommended or appointed by the governor
of this. state, or the president of the United States, as a
day of thanksgiving or of fasting and prayer, or other
religious observance, shall for all purposes whatsoever, as
regards the presenting for acceptance or payment, and of
protesting and giving notice of the dishonor of any bill
of exchange, bank check, negotiable note or other negoti-
able instrument hereafter made, be considered and treated
as a Sunday and public holiday; and every such bill, check,
note or other negotiable instrument, which would other-
wise be presentable for acceptance or payment, on any
such holiday, or on a Sunday, shall be deemed to be pre-
sentable for acceptance or payment on the secular or busi-
ness day, nota holiday, next preceding such holiday or
Sunday. Whenever any such holiday shall fall on a Sun-
day, the Monday next following shall be deemed a public
holiday for any and all the purposes aforesaid, and in that
case every such bill, check, note, or other negotiable instru-
ment hereafter made, which would otherwise be presentable
for acceptance or payment on the said Monday, shall be
deemed to be presentable for acceptance or payment on
the business or secular day next preceding.
§ 2847. When, if day following that on which it be-
comes due be a Sunday or public holiday.—If the day fol-
lowing that on which any such bill shall become due shall
happen to be a Sunday, the first day of January, the nine-
teenth day of January, the twenty-second day of February,
the fourth day of July, the first Monday in September,
known as labor day, the twenty-fifth day of December, or
any day appointed or recommended by the governor of this
state or the president of the United States as a day of
thanksgiving, or fasting and prayer, or other religious ob-
servance, it shall not be necessary to present it or forward
it for presentment for payment to such acceptor for honor
or referee until the first day afterwards which is not a
Sunday or one of the other days above mentioned.
