CHAP. 130.—An ACT to incorporate Tazewell street railway com-
pany.
Approved February 2, 1892.
1. Be it enacted by the general assembly of Virginia,
That C. A. Fudge, A. J. Tynes, Geo. W. Gillespie, A. J.
May, J. P. Kroll, and such others as may hereafter be
associated with them, be, and they are hereby, constituted
a body corporate under the name and style of Tazewell
street railway company.
2. The said corporation by said name shall have con-
tinuous succession, and in that name shall sue and be
sued, plead and be impleaded unto, in any court of law or
equity in this state or elsewhere where their rights may
come into question; may have and use a common geal,
and the same use, rénew and destroy at pleasure; and may
make, alter, and repeal such by-laws governing its own
members, officers, agents, employees, attorneys, or persons
dealing or having any business with it as it considers
proper, and as are not in conflict with the general laws of
the state. And said corporation may acquire, purchase,
accept, hold, enjoy and convey any property, real, personal
or mixed, that may be necessary or profitable for the pur-
poses of its corporation, or which it may acquire in the
progress of its business. It shall have power to fix its
rates of toll for the transportation of persons or property,
and collect the same, and in general shall have all such
powers, privileges, rights and franchises as may be neces-
sary to accomplish and carry on the purposes of its incor-
poration.
3. The said company shall have power and authority ‘to
construct, equip, maintain and operate a street railway,
from Tazewell station, on the Clinch Valley division of
the Norfolk and Western railroad, to and into the town of
Jeffersonville, in Tazewell county, and along the streets of
said town, with the consent of the council of said town,
and to any point in the county of Tazewell, within five
miles of said town, with the consent of the board of su-
pervisors and the county court of said county.
4. It shall be lawful for said corporation to use horse,
mule, steam, electric or.cable power, as to it shall seem
best, to transport passengers, freights and baggage over its
line of railway.
5. The capital stock of said company shall not be Jess
than eight thousand dollars, nor more than one hundred
thousand dollars, to be divided into shares of fifty dollars
each.
6. The principal office of said company shall be located
in the town of Jeffersonville.
7. The company shall have the power and authority to
lease its road, motive power, rolling stock and other prop-
erty, and to borrow money for the use of the company,
and may secure the same by bonds and by one or more
deeds of trusts upon all or any part of its estate, franchises
or income.
8. The incorporators hereinbefore named shall consti-
tute the first board of directors of said company, and
until their successors are elected by the stockholders of
said company, shall manage the affairs of said company,
and elect a president, treasurer and such other officers as
may be necessary.
9. Said company, by its acceptance of this charter,
hereby agrees to pay all taxes, dues and demands due the
state in lawful money of the United States and not in
coupons.
10. This act shall be in force from its passage.
