CHAP. 30.—An ACT to amend and re-enact section 2961 of the
code of Virginia relative to attachments.
Approved January 30, 1890.
1. Be it enacted by the general assembly of Virginia,
That section twenty-nine hundred and sixty-one of the
code of Virginia, be amended and re-enacted as as to read
as follows:
§ 2961. On complaint by any person, his agent or
attorney, whether the claim of such person is payable or
not, to a justice of the county or corporation in which the
debtor against whom the claim is resides, or in which he
has estate or debts owing to him, or if he has removed
from the state in which he last resided, or in which he has
estate or debts owing to him, or if he has never resided in
the state in which he has estate or debts owing to him, or
if such debtor be a corporation, in which such corporation
has estate or debts owing to it, that the said debtor
intends to remove, or ig removing, or has removed his
effects out of this state, so that there will probably
not be therein effects of such debtor sufficient to satisfy
the claim when judgment is obtained therefor, should only
the process of law should be issued to obtain the judgment
—if such person, his agent or attorney make oath to the
truth of the complaint, to the best of his belief, as well
as to the amount and justice of the claim; and if the same
not payable, at what time it will be payable, the justice
all issue an attachment against the estate of the debtor
r the amount so stated.
2. This act shall be in force from its passage.
HAP. 31.—An ACT to pay teachers in the public schools of
Virginia without requiring average attendance of pupils.
Approved January 31, 1890.
1. Be it enacted by the general assembly .of Virginia,
‘hat the pay of a teacher in the public schools of this
tate shall not be governed by the daily average atten-
lance of pupils provided the average atteedance of pupils
xceeds ten.
2. All acts and parts of acts inconsistent with this act
,and the same are hereby, repealed.
DHaPp. 83.—An ACT to refund to William K. Ballow and com-
pany, of Halifax county, certain license taxes paid by them.
Approved January 31, 1890.
1. Be it enacted by the general assembly of Virginia,
That the auditor of public accounts is hereby authorized
and directed to issue his warrants on the treasurer in favor
of William K. Ballow and company, of Halifax county,
for the sum of fifty-six dollars and twenty-five cents,
being amount paid by them for a bar-room and retail
liquor license for the time during which the privilege of
said license was never exercised by them, or any benefit
derived to them from the same, they having surrendered
said privilege. )
2. This act shall be in force from its passage.
