Chap. 174.—An ACT for the relief of Margaret Waller, Lizzie
Waller, Susan Waller, Edmonia Waller, Kate Waller, and
Annie W. Waller.
Approved March 4, 1890.
Whereas it has been shown to the general assembly of
Virginia by satisfactory evidence that Margaret Waller,
Lizzie Waller, Susan Waller, Edmonia Waller, Kate Wal-
ler, and Annie W. Waller, who became sureties for
Thomas Waller, late treasurer of Stafford county, by exe-
cuting the official bond of said treasurer, are entitled to be
relieved and released from the obligations of said bond;
therefore,
1. Be it enacted by the general assembly of Virginia,
That the said Margaret Waller, Lizzie Waller, Susan Wal-
ler, Edmonia Waller, Kate Waller, and Annie W. Waller
be, and they are hereby, relieved and réleased from the
obligation and liabilities to the commonwealth incurred
and assumed by them in their execution of said official
bond.
2. Nothing in this act shall be construed or operate to
diminish or affect the obligations to the commonwealth
of the said Thomas Waller, or of Edward Waller, co-secu-
rity with said females.
3. This act shall take effect as soon as the said Edward
Waller, co-surety as aforesaid on said official bond, shall
have filed in the office of the auditor of public accounts
his assent in writing to this release.
CHAP 175.—An ACT to authorize the board of supervisors ef the
county of Henrico, Virginia to secure the right of way for a
roadway proposed to be constructed by the United States from
some point east of the city of Richmond to Seven Pines; and
to convey said right of way to the United States free of cost.

Whereas a bill has been introduced by the honorable
George D. Wise ir the congress of the United States for
the construction of a roadway by the United States from
some point east of the city of Richmond at or near the
national cemetery on the Williamsburg pike to the
national cemetery at Seven Pines, in the county of Hen-
rico, and by the terms of the said bil] the right of way
for such road is to be furnished the United States free of
cost, and the board of supervisors of the county of Hen-
rico being of the opinion that such right of way should
be furnished by the county of Henrico; therefore,
1. Be it enacted by the general assembly of Virginia,
That the board of supervisors of the county of Henrico,
Virginia, be, and it is hereby, empowered, upon the pas-
sage of the said bill by congress, to secure the right of way
for such road, according to the survey and location thereof
by the government engineers, by purchase of the land
required for said purpose. And if the said board of super-
risors cannot agree on the terms of purchase with those
entitled to the land wanted for said purpose, it shall apply
io the court of said county for the appointment of five
lisinterested freeholders (any three of whom may act)
for the purpose of ascertaining a just compensation for
such land. The appointment of said commissioners, and
the notice of the application for their appointment, and
the subsequent proceedings, shall conform to the provi-
sions of the forty-sixth chapter of the code of Virginia
of eighteen hundred and eighty-seven.
2. That if the location of the said roadway shall be
upon and along the line of any existing highway of the
county of Henrico, or upon any part thereof, the said
board of supervisors is authorized to consent to the use
thereof in the construction of the said roadway by the
said United States. And, further, should the said road-
way be located upon and along the line of the Rich-
mond, Williamsburg and Central turnpike company’s road,
or along any part thereof, the said board of supervisors is
hereby empowered to purchase the whole of the works
and property, rights and franchises of the said turnpike
company, or of any section thereof. And if the terms of
the purchase thereof cannot be agreed upon by the said
board and the said turnpike company, the said board of
supervisors shall apply to the court of the county of Hen-
rico for the appointment of five disinterested freeholders
(any three of whom may act) for the purpose of ascer-
taining a just compensation for the whole of the works
and property, rights and franchises of the said company,
or of any section thereof, as the case may be. The notice
of the application for the appointment of said commis-
sioners, and all the subsequent proceedings, shall conform
as near as may be to the provisions of the forty-sixth
chapter of the code of Virginia of eighteen hundred and
eighty-seven.
3. That when such right of way has. been acquired the
said board ig authorized to convey the same, including
the right to use the bed, or any part thereof, of any exist-
ng highway of the county, to the United States, free
of cost.
4. That to raise the money needed for the purposes of
this act this board is authorized to issue a bond or bonds
of the county of Henrico, and to make provision for the
payment of the same, which bonds shall be signed by the
chairman of the board, attested by the clerk thereof, who
shall affix thereto the seal of the board. ,
5. That should the bill now before congress, or any
future bill, authorize the construction by the United States
of a roadway from the national cemetery on the Williams-
burg pike westwardly, to the limits of the city of Rich-
mond at Fulton, all the powers herein conferred on the
board of supervisors to secure the right of way shall
become applicable to such part of the roadway: provided,
however, that nothing in this section shall be construed
to authorize the board of supervisors, under the second
section of this act, to purchase or condemn less than a
section of the road of the Richmond, Williamsburg and
Central turnpike company.
6. This act shall be in force from its passage.
