CHAP. 825.—An ACT to amend and re-enact sections 4, 7, and 9
of chapter 73 of the acts of assembly for extra session of 1887,
entitled “an act to amend an act entitled an act for working
the public roads of Fairfax county, Virginia.”

1. Be it enacted by the general assembly of Virginia,
That sections four, seven, and nine of chapter seventy-
three of the acts of assembly for extra session eighteen
hundred and eighty-seven, be amended and re-enacted so
as to read as follows:
§4. Each board shall divide their magisterial district
into so many road districts as they may deem convenient
and necessary, the bounds and number of each road dis-
trict to be entered in a book to be kept for road purposes,
and they may alter the boundaries and increase or diminish
the number thereof at any meeting of the board. In
December of each year they shall appoint an overseer for
each road district, and in their discretion they may require
a bond of him, conditioned in such penalty as they may
elect, for the faithful discharge of his duties, and shall
furnish him within one month thereafter with a copy of
this act and a book showing the boundaries of his dis-
trict, the rate that he may allow for the use of teams,
plows, and other implements, and the names of all] per-
sons entitled to work the roads, and of all persons charged
with a property tax, and the amount thereof. All male
persons, living in any road district, over twenty-one and
under sixty years of age, except duly licensed ministers
of the gospel, persons who have lost a leg or an arm, or
who may be exempted by order of the court, shall be
required to work upon the public roads in his district two
days in each year, and where a public road is the dividing
line of two magisterial districts, one-half thereof shall be
worked by each district, and it shall be the duty of the
boards of the two districts to meet together and designate
the part of the road to be worked by each.
§7. At such time as the overseer shall deem suitable he
shall give two days’ notice of the time and place of work-
ing to each person entitled to work upon the public roads.
And it shall be the duty of each person notified to attend
in person, or by an able-bodied substitute not less than
eighteen years old, with such tools as.may be required,
and perform such labor as the overseer shall direct, not
to exceed two full days in each year. And it shall be the
duty of the overseer to add to his list the name of any
person who has resided in the road district fifteen days,
which has been omitted by the board. Any person so
notified, who shall fail to appear and work as required, or
shall fail to pay seventy-five cents for each day’s failure
to the overseer within six days thereafter, shall be ad-
judged delinquent, and the overseer shall immediately
proceed to collect the same as fines are collected, or,
instead of proceeding in that manner, the overseer may,
in his discretion, make out a ticket against the delinquent
party for the amount due, with an addition of twenty-
five per centum for costs, which ticket he shall proceed to
collect, having power to distrain therefor, and collect in
the way prescribed for the collection of taxes and levies,
or he may place said ticket in the hands of the constable
of the district, or the sheriff of the county, who shall have
like powers of distress. All moneys collected by any
overseer shall be expended by him in his road district.
§9. Each overseer shall receive one dollar and twenty-
five cents for each day necessarily employed, except for
notifying hands, in lieu of which he shal! not be required
to work the two days; but his compensation for one year
shall not be more than ten dollars, except for special
services required by the board, and no compensation shall
be allowed until he has returned his book and made the
report required by the first section of this act.
