CHAP. 589.—An ACT to authorize the Brook turnpike com-
pany to increase their road toa width not exceeding one hun-
dred and eighty feet, and to set aside one portion of their road-
way for carts, drays, ani! wagons, and avother for riding horses,
carriages, and other light vehicles.
Approved March 4, 1890.
1. Be it enacted by the general assembly of Virginia.
That the Brook turnpike company be, and is hereby, au-
thorized and empowered, with the consent of the owners of
three-fourths of the land lying on or along any section or
sections of their turnpike, to increase their turnpike road to
a width not exceeding one hundred and eighty feet in any
section or sections wherein said petitioner’s land is situ-
ated, and shal] have power to condemn land in the mode
now prescribed by the laws of Virginia for similar corpora-
tions: provided, wherever buildings are destroyed full
valuation shall be allowed therefor, and when removed the
expense of removal and damages resulting therefrom shall
be borne by the said company.
2. To set aside a portion of their turnpike road for the
exclusive use of riding horses, pleasure carriages, and
other light vehicles, and to prohibit the use thereof to
carts, wagons, and drays, under a penalty of ten dollars
for every violation of these rules prohibiting the same: pro-
vided, that said company keep in as good order along said
portion of their road so set aside for riding horses and
pleasure carriages a stone or macadamized road not leas
than eighteen feet in width for all said drays, carts, and
wagons: provided, further, that said road of eighteen feet
constructed as aforesaid shall extend the whole length of
said turnpike and shall be completed within two vears
from the passage of this act.
3. This act shall be in force from its passage.
