CHAP. 407.—An ACT to amend and re-enact an act entitled an
act to incorporate the towu of Waverly, in the county of Sus-
sex, approved February 27, 1879.

1. Be it enacted by the general assembly of Virginia,
That chapter one hundred and fifty-one of the acts of
assembly of Virginia, session of eighteen hundred and
seventy-eight—-seventy-nine, entitled an act to incorporate
the town of Waverly, in the county of Sussex, be amended
and re-enacted so as to read as follows:
§1. That the town of Waverly, in the county of Sussex,
as the same has been or may be laid off into lots, streets,
and alleys, shall be, and the same is hereby, made a town
corporate by the name of the town of Waverly, and by
that name shall have and exercise the powers conferred
upon towns by the general laws of the state of Virginia
relative to towns, so far as the provisions of the same are
not inconsistent with the provisions of this act.
§2. The boundaries of said town shall be as follows:
Beginning at Lobb’s shop crossing; running thence by
air-line to Burt’s crossing on the Norfolk and Western
railroad: thence along the county road leading to Black-
water toa point intersected by the county road leading to
Waverly; thence by air-line to culvert on Norfolk and
Western railroad where said road crosses the Spring
branch; thence by air-line back to Lobb’s shop crossing
before mentioned.
§ 3. That the officers of said town shall consist of five
councilmen, a mayor, and a sergeant, all of whom shall
remain in office until their successors are elected and quali-
fied; and the said council shall have power to pass all by-
laws and ordinances necessary for the proper government
of said town not in conflict with the constitution and
laws of the state of Virginia or the United States; and
also to provide for keeping the streets in order and paving
the same, and for other necessary improvements and sani-
tary regulations.
§ 4. The council shall elect from their own number a
president, who shall preside at all meetings of the coun-
cil, and when they are equally divided shall give the cast-
ing vote; and they shall be vested with all the powers of
a justice of the peace within the limits of said town, and
for one mile beyond the limits of said town.
§5. P. Fleetwood, J. 8. Ellis, J. F. May, J. E. West, and
L. W. Doyle are hereby appointed councilmen of said
town; R. L. Cobb is hereby appointed sergeant of said
town; and David May, junior, is hereby appointed mayor

of said town; and all of said officers shall have and exer-
cise all the powers herein granted to said officers, and
granted said officers by the general laws of this State, and
shal] remain in office until their successors shall be
elected and qualified according to law.
§6. The said sergeant shall be vested with the full
powers of a constable within the limits of said town, and
also for one mile beyond the limits of said town; heshall
collect town taxes and have power to distrain and sell
therefor, in like manner as a county treasurer may dis-
train and sell for state taxes; he shall qualify before the
county court of Sussex county and give bond in the
penalty of one thousand dollars, conditioned for the faith-
ful discharge of his duties as sergeant.
§7. The said council shall have power to impose a tax
not exceeding twenty-five cents on the hundred dollars for
all purposes: provided, however, that said council may
impose a further tax not exceeding eighty cents on the
hundred dollars when authorized by a two-thirds vote of
all the legally qualified votes of said town.
2. This act shall be in force from its passage.
CuapP. 408.—An ACT declaring the north folk of Holston rivera
miicrt fence in certain portions of Washington and Scott
counties.
Approved March 8, 1890.
1. Be it enacted by the general assembly of Virginia,
That the north folk of Holston river be made a lawful
fence from the bridge where the South Atlantic and Ohio
railroad crosses the said river in Washington county, down
the same to Smith’s ford in Scott county.
2. This act shall be in force from its passage.
