CHAP. 352.—An ACT to amend and re-enact sections 3 and 5 of
chapter 250 of the acts «f 1869-70, approved July 9, 1870, enti-
tled an act to incorporate the town of Gordonsville.
Approved February 24, 1890.
1. Be it enacted by the general assembly of Virginia,
That sections three and five of chapter two hundred and
fifty of an act approved July ninth, eighteen hundred and
seventy, entitled an act to incorporate the town of Gor-
donsville, be amended and re-enacted so as to read as fol-
lows:
§3. The officers of said town shall consist of nine trus-
tees, who shall compose the council (five of whom shall
constitute a quorum to transact business), and a sergeant,
who shall hold their offices for two years, and until their
successors are duly elected or appointed and qualified.
The said council shall have: power to pass all by-laws
and ordinances for the government of said town that they
may deem proper (not in conflict with the constitution of
this state or of the United States), and also to provide for
keeping the streets in order and paving the same, and for
other necessary improvements, for which purpose the said
council may levy such tax as they deem proper, not to ex-
ceed ninety cents on the one hundred dollars of the
assessed value of property, and may impose such license
tax as is authorized upon business under the laws of the
state.
§5. The sergeant of said town shall be appointed by the
said council at its regular meeting in May, eighteen hun-
dred and ninety, and shall hold his ‘office for two years,
beginning on the first day of July succeeding his appoint-
ment. But before entering upon the duties of his office
he shall give bond, with good security, in a sum to be
fixed by the said council, conditioned for the faithful per-
formance of all the duties of his office; said bond to be
subject to the approval of the said council. Said sergeant
shall be a conservator of the peace within the limits of
said town, and invested with all powers of a constable,
shall have power to make arrests for all offenses within
said town and within half a mile of the limits thereof,
and shall] be entitled to such fees as the law allows to con-
stables for similar services. He shall collect all taxes due
the said town, and faithfully account for the same to the
said council, and shall annually settle his accounts with
the said council at such time as said council may require,
of which time said sergeant shall have thirty days’ notice.
In making said collections the said sergeant shall have
the same power to distrain and sell as is given to the
treasurer and his deputies in the collection of state and
county taxes. Said sergeant may be removed from office
by the said council for any neglect or violation of duty
under the laws of the state or by the by-laws or ordi-
nances of said town.
2. This act shall be in force from its passage.
