CHAP. 107.—An ACT to authorize the Radford land and imprev-
company to erect a dam across Little river.
Approved January 28, 1890.
1. Be it enacted by the general assembly of Virgin:
That the Radford land and improvement company is h«r-
by authorized and empowered to erect a dam or dat:
across the Little river at any point or points on the s3:
river within four miles of the New river, and to div-*
therefrom so much of the water thereof as may be
quired to supply water-power or water to any town, mil:
factories, or other establishments which may be ereci-
or established at or near Radford, New river depot, a:
other points on or near the Little river or the New mn:
within seven miles of such dam, with full power to er '
maintain and operate the same with all the necessa™
sluices, locks, race-ways, and other appliances, and tous"
supply such water-power in producing and furnish::-
lights, heat, motive-power by electricity, cables, pipes.
other means, to such persons, partnerships, and corpo:
tions residing in Montgomery and Pulaski counties as m3:
desire to use or have the same: provided, that when dam
age may arise to land from the overflow of water or othr
wise from the erection of said dam, the individuals whe
property may be injured thereby shall be entitled for such
injury to such damages as ajury may assess in the manner
now prescribed by law in such cases: provided, however,
that nothing in the act shall be construed to authorize
the said company to erect the said dam on any land not
owned by said company “nor to erect, maintain and operate
any sluices, locks and raceways through the lands of ano-
ther without first acquiring the right so to do by contract
or proceedings for condemnation under the general law.”
2. This act shall be in force from its passage.
