Chap. 58.—An ACT to amend the third and fourth sections of an act
to incorporate the Virginia marble company, approved March 30,
1869, and to add additional sections thereto.
Approved April 11, 1887,
1. Be it enacted by the general assembly of Virginia, That
the third and fourth’ sections of an act entitled an act to in-
corporate the Virginia marble company, approved March
thirteenth, ciehteen hundred and sixty-nine, be amended and
re-enacted so as to read as follows
§ 3. That it shall be lawful for the said company to con-
struct and operate one or more railroads not exceeding fifty
miles in length, upon which to transport marble and other
stones and minerals from the quarries to any point on the
Potomac river, Virginia Midland railway or the Washington,
Ohio and Western, or on any other railroad hereafter to be
built which may pass through the county of Loudoun, and
also to improve tho navigation of Goose creek from the said
quarries to its mouth by locks and dams; and for these pur-
poses the said company is authorized to acquire the right of
way by purchase or otherwise according to the laws of Vir-
ginia, and also to acquire, in dike manner, all sueh lands as
may be necessary for the Gomplete equipment and construe-
tion of its roads, stations, Jocks, and damns. And the said
company shall have power to consolidate, lease out, or con-
nect its railway or canal with any line of railway now or
hereafter constructed through this State.
§ 4. The said company may issue bonds at such times and
for such amounts as it may deem proper, either for the pur-
poses of developing its property and facilitating its business,
or constructing a railroad or improving the. navigation of
Goose creek, and may exccute mortgages on any part or all
of its property and franchises, and upon its railroad or canal,
tosecure the payment thereot It shall also be lawful for the
said Company to issue shaves of common and preterred and
non assessable stock to such amount as the said company, by
vote of its stockholders, shall deem proper to issue for the
purposes of developing its quarry, or constructing a railroad
or canal, or advancing the purposes for which the company
is chartered.
2. Subject to the amendments set out in this act, the act
chartering the said company, approved on the thirtieth day
of March, eighteen hundred and sixty-nine, is in all other
respects, reaflirmed, except that the company shall not pay
its taxes in coupons, but in gold, silver, National bank notes,
or lawful money of the United States.
3. This act shall be in turce from its passage.
