Chap. 400.—JOINT RESOLUTION authorizing the auditor of public
accounts to prosecute suit against 8. Brown Allen, H. H. Dyson, and
D. R. Reveley, late commissioners of the sinking fund, or any or
either of them, and the sureties upon their official bonds, for the
amount paid by the State to the Kendall bank note company.

Resolved (the Senate concurring), That the attorney-gene-
ral be and he is hereby instructed to investigate the claims
of the commonwealth against S. Brown Allen, late auditor of
ublic accounts, H. H. Dy son, late second auditor, and D. R.
veley, late treasurer, who as such, constituted the commis-
sioners of the sinkin fund, and if in bis opinion they or any or
either of them are Tiable to the commonwealth by reason of
their action in regard to the Kendall bank note contract, then
the auditor of public accounts shall institute and prosecute
to judgment, in the proper court, an action against said 8.
Brown Allen, H. H. Dyson, and D. R. Reveley, or such of
them asin the opinion of the said attorney-general are liable,
and the surcties upon their official bonds, respectively, as
aforesaid, for the recovery of such sum or sums as said parties
may be liable to the commonwealth as aforesaid.
2. This joint resolution shall be in force from its passage.
