Chap. 395.—An ACT to amend and re-enact section 4, and to repeal
section 8 of chapter 198 of an act of the general assembly of Vir-
ginia, approved March 1, 1884, entitled an act to provide for the
improvement and working of the roads of the county of Henrico,
and for the construction of bridges therein.
Approved May 23, 1887.
1. Beit enacted by the gencral assembly of Virginia, That
section four of chapter one hundred and ninety-eight of an
act of the general assembly, approved March one, eighteen
hundred and cighty-four, entitled an act to provide for the
improvement and working of the roads of the county of
Henrico, and for the construction of bridges therein, and to
repeal an act of the general assembly of Virginia, approved
March six, eighteen hundred and eighty-two, entitled an act
to provide for laying out and working roads in Henrico
county, be amended and re-enacted so as to read as follows:
§4. Each said road surveyor appointed under this act shall
superintend such of the roads of his precinct as may have
been put under his charge, and see that they are kept in the
condition required by the first section; and across any stream
where it 18 necessary and practicable, a sufficient bridge,
bench, or log for the accommodation of foot-passengers; and
when any more important bridge or causeway is necessary,
and it is practicable for him to have it made, he shall cause
the same to be made twelve feet broad at the least, and safe
and convenient. Every bridge or causeway in bis precinct,
under his charge, shall be kept in good order. For the pur-
pose of keeping in order the roads of his precinct under bis
charge, he shall summon not oftener than twice a year, all
male persons in his district, subject to road duty under the
gencral road law, to attend with proper tools, and work the
roads of said precinct; but no persen shall be required to
work upon suid roads more than two days in any ono year;
and if any person fail to attend in person or by sufficient
substitute, fur each day of such failure there shall be paid to
said surveyor, upon a ticket to be made out by said surveyor
and presented by him, by the person in default, if of full age,
or if he be an infant, by his parent or guardian, the sum of
seventy-five cents. If the money be not paid twenty days
prior to the time hereinafter specified for the return of the
ill for said fine, he shall add to said ticket against such de-
linquent party for the amount of said fine, thirty-three and
one-third per centum, and shall annually, on such day as the
board may designate, return the bills against such delinquent,
partics to the board of supervisors. And it sball be the duty
of the said board, without delay, to place the said bills in thd
hands of a constable or the treasurer of the county for col;
lection, or it may appoint one or more collectors for suc
purpose. Tho officer having charge of the collection of suc
fines may distrain therefor in the same manner as for taxes
and levies. He shall, within sixty days, account to the said
board for all fines collected, and shall receive for his compen-
sation fifteen per centum of the amount collected, and the
said surveyor shall receive for his services five per centum of
the amount so collected. No person residing within the
bounds of any road precinct established by the board, shall
be exempt from said duty therein by reason of the public
road nearest him being worked by contract or by the force
operating under the direction of the board. If the surveyor
of any precinct is unable, with the means and labor at his
disposal, to keep in good order the roads of which he is sur-
veyor, the said board may authorize him to spend such sum
as it may deem reasonable for the purpose of putting the
same in good repair. Thesaid board shall require, upon such
day as it may designate, said surveyors to make such report
to it as is required by the twenty-third and twenty-seventh
sections of the general road law. Each surveyor shall re-
ceive for his compensation the sum of one dollar and fifty
cents for each day sworn to by him as actually employed,
not to exceed ten days in any one year.
2. That section eight of said chapter is hereby repealed.
3. This act shall be in force from its passage.
