Chap. 349.—An ACT to incorporate the town of McDowell, in the
county of Highland.
Approved May 21, 1887.
1. Be it enacted by the general assembly of Virginia, That
the town of McDowell, in the county of Highland, as the
same may hereafter be laid off into lots, streets, and alleys,
shall be and the same is hereby made a town corporate by
the name of the town of McDowell, and by that name shall
have and exercise the powers conferred upon towns by the
fifty-fourth chapter of the Code of Virginia, edition of eigh-
teen bundred and seventy-three, so far as the same shall be
applicable to the governments of towns of less than five thou-
sand inhabitants, and not inconsistent witb the provisions of
this act. .
2. That the boundaries of said town shall be as follows:
Beginning at a large oak west of the Bullpasture bridge,
north sixty-one and three-quarter degrees, west seventy-six
poles, passing through middle of large pond to a large white
oak, south of the graveyard; north seventy-five and one-
quarter degrees, west sixty-two poles, crossing Crab run
to a large walnut in Milton Hook’s field; north two degrees,
east seventy-three six-tenths poles, crossing the pike at forty-
two poles to a cherry tree on eastside of Rexrode’s orchard;
north twenty-one and one-half degrees, east fifty-five and
five-tenth poles, to a leaning locust on northside of School-
house run; thence down said run with its general direction;
south seventy-six and three-quarter degrees, east eighty-one
and six-tenths poles, to a maple on eastside of run; north
seventy-two and one-half degrees, east forty-two and seven-
tenths poles, to a locust on northside of run; south eighty-
four degrees, east thirty poles, crossing public roads at three
poles to a forked willow; south one degrce, west forty-three
poles to a willow on westside of Bullpasture river; south
twenty-one degrees, east seventy-four and six-tenths poles to
a large willow south of the Water gap; south nine and one-
quarter degrees, west thirty-six poles, passing the mouth of
Crab run at sixteen poles to a sycamore on westside of said
river; thence south twenty-three and three-quarter degrees,
west sixty and five-tenths poles to the beginning; containing
within said boundary one hundred and seventy-five acres.
3. That the officers of said town shall consist of five coun-
cilmen, a mayor, and a sergeant; that the councilmen of said
town shall be H. Sheffey Roller, C. S. Peterson, B. Hiner
Hansel, James B. Bradshaw, and John R. Rexrode; that J.
S. McNulty shall be mayor, and H. E. Bryant shall be ser-
geant, all of whom shall remain in office until their succes-
sors are elected and qualified; and a majority of the council-
men shall constitute a quorum for the transaction of business.
4. That the annual election of officers provided for by this
act, sball be held on the last Saturday in May.
5. That all the land included in the boundaries aforesaid
not embraced in plat of town lots, numbered and valued, shall
not until the growing wants of the town require it, to be laid
off into town lots or subject to taxation for.town purposes,
nor until such time shall strects and alleys be opened through
the same.
6. This act shall be in force from its passage.
