Chap. 328.—An ACT to amend and re-enact sections 2, 3, 4, and 6 of
an act entitled an act. to incorporate the town of Clifton Forge, in
the county of Alleghany, approved December 1, 1884.
Approved May 20, 1887.
1. Beit enacted by the general assembly of Virginia, That
sections two, three, four, and six of an act to incorporate
the town of Clifton Forge, in the county of Alleghany, ap-
proved December one, cighteen hundred and eighty-four, be
amended and re-enacted so as to read as follows:
§ 2. The boundaries of said town shall be as follows: Be-
ginning at the Carding mill dam, thence in a straight line to
C. M. Berger's slaughter-house; thence along county road to
point opposite east end of Chesapeake and Ohio caboose
tracks; thence to Jackson river; thence crossing same to
county road on south side of said river; thence along said
county road to a point on bill opposite the stone bridge across
Mill creek; thence to said bridge; thence up Mill creek to the
beginning. :
€3. The government of said town shall be vested in a
mayor and a council of six, who shall be residents of said
town. They shall be elected every two years by the qualt-
fied voters who resido in the corporate limits of said town.
They shall compose the council thereof, and five of them
shall constitute a quorum for the transaction of business.
Said mayor and council, together with a town sergeant, who
shall be 2 qualified voter of said town, shall be chosen by
ballot on the fourth Thursday in May, eighteen hundred and
eighty-seven, and every second year thereafter, and shall
enter upon their duties on the first day of July succeeding
their election; and they sball hold their offices for two years,
and until their successors are elected and qualified. Any
person entitled to vote in the county of Allezhany for mem-
bers of the general assembly, and who has been a resident
for three months in the corporate limits of the town of Clifton
forge, shall be entitled to vote at all elections under this act.
The council shall appoint three qualitied voters of said town,
one of whom shall act as clerk, to hold said election between
the hours of eight ante meridian and four post meridian.
Said three judges of election shall decide any contest with
reference to the right to vote of any individual, and shall
count the ballots, and in case it is impossible to determine
the seven who have the highest number of votes by reason
of a tie, the said clerk shall by lot determine the matter in
the presence of his associates, and of not more than two per-
sons selected by each candidate affected by said lot. Said
three judges of election shali determine who have received
the greatest number of votes in such election, and shall cer-
tify the same and an abstract of the votes on the poll books,
and return the same, together with the ballots, to the clerk
of the council, to be by him preserved; and said clerk shall
immediately thereafter make up and return to each of the
persons elected, a certificate of election.
§4. The council shall at their first mecting in July of each
year, clect one of their own number who shall be clerk of said
council, and said council may require such bond from said
clerk in such penalty as said council may determine, con-
ditioned for the faithful performance of his duty, and shall
have power by a two-thirds’ vote, to remove the same from
office at any time. All the officers of the corporation shall
serve without compensation, except as hereinafter provided.
The said council shall appoint itsown timeof meeting, and may
fill any vacancy arising in their own body for the unexpired
term. The bonds herein provided for shall be executed with
security, to be approved by the council, and shall be tiled
with the clerk.
$6. The said council may annually levy a tax tor corpora-
ten purposes, which on no property shall exceed forty cents.
on the one hundred dollars valuation: provided however, that
said council may impose a further tax, not exceeding fifty
cents on the one hundred dollars, when authorized hy a two-
thirds’ vote of all the legally qualiticd voters of said town.
Said tax upon property herein authorized, shall be only upon
such subjects of taxation by the State of Virginia as are as-
sessable and assessed for State taxation within the county of
Alleghany, and shall in all cases be based upon the assess-
ment made by the officers of the State tor State taxation.
