Chap. 324.—An ACT to amend and re-enact section 1 of an act enti-
tled an act to amend section 5 of chapter 61 of the Code of 1873, in
reference to the construction of branch railroads or lateral works.

1. Be it enacted by the general assembly of Virginia, That
section one of an act entitled an act to amend section five of
chapter sixty-one of the Code of eighteen hundred and sev-
enty-three, in reference to the construction of branch rail-
roads or lateral works, approved March fourth, eighteen hun-
dred and cighty, be amended and re-enacted s0 as to read as
follows: ,
§5. The president and directors of any company incorpo-
rated to construct a railroad or other work of internal im-
provement, may cause to be made in connection therewith.

ral mecting by two-thirds of all the votes of all the stock-
holders, may cause to be made branch railroad or lateral
works not exceeding fifty miles in length in the State of Vir-
ginia: provided that no branch road constructed under this
act shall acquire any exclusive right to the occupancy of any
mountain pass, where it is practicable to build more than one
road.
2. This act shall be in force from its passage.
