Chap. 297.—An ACT to authorize the qualified voters of Mechanics-
burg magisterial district, in the county of Bland, to vote a tax for
road purposes in said district.
Approved May 18, 1887.
1. Beit enacted by the general assembly of Virginia, That
it shall be lawful for the judee of the county court of Bland
county, Virginia, in term time or vacation, upon tho applica-
tion of ten frecholders of said district, to ‘order an election
to be held at the voting precincts in said county at such time
as the said court or judge may order, to take the sense of
the qualified voters of said district on the question as to
whether the board of supervisors of said county shall levy a
tax on the real and personal property of said district, not to
oxceed twenty cents on the one hundred dollars of value, to
be applied in the construction of a public highway from
Walker's creek, in said district, near Mechanicsburg, to the
Pulaski county line on Walker's mountain, at the most prac-
ticable point. Said election shall be held by three commis-
sioners, to be designated in the order directing the election,
who shall certify the result of said election to the judge of
said county court. The ballots used at such election shall
have written or printed thereon for road tax and against
road tax.
2. If it shall appear from said returns that a majority of
the votes cast are in favor of said road tax, and that a ma-
jority of the freeholders voting on the question voted there-
for, then the board of supervisors of said county shall at its
next meeting or a subsequent meeting, proceed to levy said
tax, and provide for its collection in the mode now prescribed
by law for the collection of road tax, and also provide for its
proper application by the road surveyor of the said district,
or any other person whom the said board of supervisors may
Beleet for the opening of said road. The said board of super-
visors will require of the person authorized by them to apply
the said money in the opening of said road, a bond with good
security in the penalty of at Icast double the amount of the
money to go into his hands, and conditioned for the faithful
discharge of his duties and the application of said money; the
said board of supervisors may authorize the supervisor of
said district on its behalf to superintend the construction of
said road.
3. This act shall be in force from its passage.
