Chap. 291.—An ACT to amend and re-enact sections 2, 3, and 14 of
chapter 54 of the Acts of the General Assembly, extra session of
1884, in relation to the appointment of a board of visitors of the
Virginia Military Institute.
Approved May 18, 1887.
1. Be it enacted by the gencral assembly of Virginia, That
sections two, three, and fourteen of chapter fifty-four, Acts
of extra session of cightcen hundred and eighty-four, be
amended and re-enacted so as to read as follows:
§2. There shall be a board of visitors for the institution
composed of the adjutant-general, the superintendent of pub-
lic instruction, and nine other persons, three of whom shall
be selected from the division of the State in which tbe insti-
tution is located, and two from each of the other grand divis-
ions ot the State, who shall be appointed and commissioned
by the governor, subject to confirmation by the Senate. The
governor shall also fill all vacancies that may occur, and the
appointment to fill the-vacancy shall be for tbe unexpired
term of his predecessor, but subject to the confirmation of
Senate at its next session. The term of office of the board
of visitors shall commence on the first day of January, eigh-
teen hundred and ecighty-cight, and hold as follows: Under
the first appointment under this act, three members shall
hold for one year, threo for two years, and three for three
years, and all succeeding appointments shall be for three
years, Five members of said board shall constitute a quorum
for business. They sball be and are hereby declared to bes
corporation under the title of the Virginia Military Institute,
and as such may sue and be sued for any cause or matters
which have heretofore arison, as well as for any causo or
matter which may bercaftor ariso.
§ 3. The board shall meet at the institution, or at any other
places than the institute when in their opinion it shall bo ne-
cessary to doso. A mecting shail be held annually at such
time as may have been designated for their annual meeting
in their last resolution on the subject. A mecting may also
be called at any time by the adjutant-general, or the superin-
tendent of the institution, when either may deem it advisa-
ble, and the board may adjourn trom timo to time.
§ 14. Tho board of visitors shall appoint professors to give
instruction in military science and in such other branches of
knowledge as they may deem proper; shall fix tho salarics of
professors, and may remove them for good cause, but no order
to remove a professor sball be made without the concurrence
therein of a majority of the whole number of visitors, and
the board shall forthwith communicate to the governor ao
full statement of the reasons on which the removal was made.
3. That all acts and parts of acts inconsistent with this
act, be and the samo are hereby repealed.
4. This act shall be in force from its passage.
