Chap. 278.—An ACT to transfer to the board of road commissioners of
Back Creek magisterial district, Frederick county, the State’s inter-
est in the Hardy and Winchester turnpike.

Whereas by divers acts of the general assembly of Vir-
gima the Hardy and Winchester turnpike company was
legally incorporated, and in pursuance of said charter of said:
company the said turnpike was constructed from a point on
northwestern grade about four miles from the city of Win-
chester to the West Virginia line, the whole of said road ly-
ing in Back Creek magisterial district, Frederick county ;
and whereas the State of Virginia now owns a large majority
of the stock of said turnpike company, which anid turnpike
has been greatly neglected by the owners of said stock; there-
fore,
1. Be it enacted by the general assembly of Virginia, That
the board of public works be and they are hereby authorized
and directed to transfer all the right, title, and interest of the
State of Virginia in said road, or so much thereof as lies in
the county of Frederick, to the board of road commissioners
of Back Creek magisterial district of Frederick county, and
their successors forever, together with all bridges and other
property appertaining thereto.
2. It shall be the duty of the said board of road commis-
sioners to take charge of so much of said road as lies within
the said county, and cause the same to be put and kept in
repair out of the said district fund. It shall forthwith ap-
point such officers and agents as may be needed for the effi-
cient operation of said road, and may remove the same from
time to time as the said board may deem proper. It shall
cause the tolls to be faithfully collected within the rates pre-
scribed by law and regularly applied to the maintenance and
improvement of said road, and if there be any surplus reve-
nue, it shall be placed to credit of the said district road fund.
It shall have the same power and rights as have been here-
tofore held and exercised by the board of public works, and
by the incorporation known asthe Hardy and Winchester turn-
pike company. But, in the Uiscretion of the said board, the
said road may be also worked as a county road under the
provision of the act of the general assembly of Virginia, ap-
proved February twenty-six, eighteen hundred and eighty-
four, entitled an act to provide for working roads, repairing
bridges, and opening new roads in the counties of Fredericle,
Clarke, Warren, and Augusta.
3. This act shall be in force from its passage.
