Chap. 262.—An ACT to amend and re-enact an act entitled an act to
release and to transfer to the counties of Highland and Augusta the
interest of the commonwealth in the Staunton and Parkersburg
turnpike road, and to add additional sections thereto.
Approved May 16, 1887.
1. Be it enacted by the veneral assembly of Virginia, That
sections one, two, three, four, seven, and eight of chapter one
hundred and fifty-eight of the Acts of eighteen hundred and
eighty-three and eighteen hundred and eighty-four, approved
February twenty-fifth, eighteen hundred and eighty-four, be
amended and re-enacted so as to read as follows:
€1. That all the interest of the commonwealth in that
portion of the Staunton and Parkersburg turnpike road, lying
between the forks of the road at James Cross’s, in the county
of Augusta and the West Virginia State line, be and is hereby
released and transferred to the county of Highland, and said
county is hereby vested with all the powers heretofore vested
in the commonwealth or the board of public works relative
to said road.
§2. The board of supervisors of said county of Highland
shall take charge of said portion of said road, and have the
same worked and kept in repair as provided by law.
§3. The said board of supervisors of Highland county shall
appoint a superintendent of said road bercby transferred, who
shall qualify before the county court of said county by taking
the usual oath of office, and shall continue as such until his
successor has duly qualified. The term of office of said
superintendent shall be two years, and shall commence on the
first day of April, eighteen bundred and cighty-eight.
§4. The said superintendent shall biennially at the March
term of suid county court, let to contract to the lowest suit-
able bidder, the work of keeping said road in lawful repair,
notice of which letting shall be posted for ten days at each
public place on the line of said road in said counties, and also
published in a newspaper in said counties, at the discretion of
the board of supervisors. Thesaid letting shall be as a whole
or in sections, at the discretion of the superintendent, and
for two years ending on the first of April. Tho bids shall be
in writing, signed by the contractor, and the superintendent
shall deliver the same under seal to the board of supervisors
for its approval or rejection at the first meeting thereafter.
The contractor shall be required to give bond with good se-
curity, in a penalty double the amount of his bid for the faith-
ful performance of his contract, and a recovery may be had
for any breach of said contract in the name of the county,
for the benefit of said road by motion in the county court of
Highland, after ten days’ notice to the contractor and his
sureties. The attorney for the commonwealth shall institute
and prosecute such motion.
§7. The said road shall be continued and operated as a
toll-road, and all the rights and powers now vested in the
commonwealth with reference to the collection of tolls upon
State roads are hereby vested in said county of Highland.
§8. The said toll shall be collected from the gate-keepers
and accounted for by the treasurer of said county of High-
land, and paid out on the order of the board of supervisors:
provided that said tolls shail not be used for any other pur-
poses than keeping said road in repair and paying the com-
pensation of the superintendent as hereinafter provided.
2. The said board of supervisors may, in its discretion,
adopt any other plan of working and Keeping said road in
repair that it may deem advisable, Instead of the contract
plan herein provided. .
3. The remainder of said road Iving in the county of Au-
gusta, between the city of Staunton and the forks of’ the
road nearJames Cross’s in seid county of Augusta, is hereby
turned over to suid county of Augusta to be w ‘orked and ope-
rated under the road law of that county.
4. Section twelve of said act is hereby repealed.
5. This act shall be in force trom its passage.
