Chap. 244.—An ACT toincorporate the town of Banister in the county
° of Halifax.
Approved May 16, 1887.
. 1. Beit enacted by the general assembly of Virginia, That
the town of Banister in the county of ILalifax, as the same
has heretofore been or may hereafter be laid off into lots,
strectas, and alleys, and within the following boundaries: Be-
ginning at a rock on the top of the high bill on the north-
side of Toot’s creck, nearest the courthouse; thence north
twelve and one-third deyrees, east ninety poles, seventeen
links to a pine ina graveyard; thence north twenty-seven
and one-quarter degrees, cast one hundred and two poles to
a pine at Mrs. M. W. Moore’s stable lot; thence north twenty-
five and one-third degrecs, cast twenty-seven poles toa red
oak in the old Methodist church lot; thence north thirty-one
and one-third degrecs, east seventy-two poles to a pine;
thence north thirty-seven degrees, east fitty-three poles to a
cedar at the corner; thence across the bridge road north
seventy-two and one-half degrees, west twenty-six poles to a
pear tree; thence south sixty-five and one-half degrees, west
fifty-cight pules to a cherry tree; thence south forty-one and
one-fourth degrees, west one hundred and twelve poles to an
apple treo; thence north seventy-four degrees, west forty-two
poles to a white oak; thence south twenty-two and one-
quarter degrees, west twenty-eight poles to a rock; thence
north seventy-four and one-half degrees, west seventy-one
poles to northwest corner of Willingham’s lot; thence south
forty-seven degrees, west thirty-six and one-half poles to
pines in woods; thence south fifty and one-half degrees, west
forty-eight poles to Pointers; thence south sixty-three de-
grees, west twenty-four poles to a post; thence south five
and one-half degrees, east thirty-seven poles to N. T. Green's
stable; thence south nine and three-quarter degrees, west
thirteen poles to a cedar; thence south sixty-tive degrees,
east two hundred and twenty-five and one-half poles to the
beginning, shall be and the same is hereby made a town cor-
porate by ‘the name of Banister, and by that name shall have
and exercise the powers conferred upon towns by the fifty-
fourth chapter of the Code of Virginia, edition of eighteen
hundred and seventy-three, and be ‘subject to all the provis-
ions of said Code and to all laws now in force or which may
hereafter be enacted in reference to the government of towns
of less than five thousand inhabitants, so far the same are
not inconsistent with the provisions of this act.
2. Be itturther enacted, That R. W. Watkins, N. T. Green,
W.A. Rovers, R. H. Edmondson, R. H. Easley, W.N. Dickens,
B. M. Estes, J. S. Easly, and James H. Guthrie, shall con-
stitute the board of trustees of said town, and in them and
their successors the government of said town shall be vested.
3. That the trustees aforesaid shall upon taking the oath
prescribed by law, enter upon the duties of their offices, and
may elect one of their number president, who shall act as
mayor of the said town, and who, as well as the members of
said board of trustees, shall hold their respective offices until
July first, eightcen bundred and ecighty-seven, or until their
successors are duly elected and qualitied; and the said board
may elect a town sergeant, who shall act as such until his
Succensor is elected and qualitied. ‘
That all the officers of said town shall hold their respec-
tive offices for the term of two years, or until their successors
are elected and qualified; and elections therefor shall be beld
biennially. The first election to be held on the fourth Thurs-
day in May, cighteen hundred and eighty-seven; the second
on the fourth Thursday in May, eighteen hundred and eigbty-
nine, und so forth: provided that in case no election be held
on the fourth Thursday in May, eighteen hundred and eighty-
seven, this shall not effect the validity of this act, nor vacate
the offices of said town, but all of said officers shall continue
to hold their respective offices until the election of their suc-
cessors on the fourth Thursday in May, eighteen hundred
and ei¢hty-nine, and their qualification according to law.
5. The board of trustees of said town shall be empowered
and are hereby authorized to levy and collect a license tax
on all persons doing business in said town for which a license
tax is required under the State laws; and all acts or parts ot
acts inconsistent with this act are hereby repealed so tar as
said town of Banister in concerned,
6. ‘This act shall be in torce from its passage.
