Chap. 156.—An ACT to amend an act entitled an act to incorporate

1. Be it enacted by the general assembly of Virginia, That
the act passed March nineteenth, cighteen hundred and sixty.
entitled an act to incorporate the town of Milford, in the
county of Caroline, be amended and re-enacted so as to read
as follows:
§1. Beit enacted by the general assembly of Virginia, That
the village of Milford, in the county of Caroline, as the same
has heretofore been laid off into lots, streets, and alleys, and
as the same may be hereafter laid off into lots, streets, and
alleys, be and the same is hereby made a town corporate by
the name of Milford; and by that name shall have and exer-
cige the powers conferred upon towns of less than five thou-
sand inhabitants, by the fitty-fourth chapter of the Code of
Virginia, and all amendments thereto, and shall be subject to
all the provisions of the said chapter and such amendments,
except so far as may be herein otherwise provided.
&2. The ofticers of said town shall consist of seven trus-
tees, who shall compose the council, four of whom shall con-
stitute a quorum; and a sergeant, who shall hold their offices
for the term of two years, and until their successors are
elected and qualified. The said council shall have power to
pass all ordinances and by-laws for the government of' said
town that they may deem proper, not inconsistent with the
laws of the United States or this State, and shall provide for
keeping the stretts in order and other necessary improve-
ments; for which purpose they may levy such tax as they
may think necessary, not exceeding fifty cents on the hundred
dollars in any one year.
§3. The council shall elect from their own number a presi-
dent, who shall, ex-ofticio, be the mayor of said town, and
shall preside at their meetings; he shall be invested with all
the powers of a justice of the peace, within the limits of said
town.
§4. John W. Gill, W.S. Stone, James E. Grimes, Thomas
B. Gill, Arthur Lyell, J. W. Knight, and W. N. Blatt, are
hereby appointed trustees of said town, and shall have and
exercise all the powers berein granted to said officers, and
shall remain in office until their successors are elected and
qualified according to law.
§5. The said council shall, when organized, and every two
years thereafter, appoint a sergeant, who shall be a conaerva-
tor of the peace, and be invested with the full powers of a
constable within the limits of said town; and also shall have
power to arrest offenders within one mile of said limits for
offences committed therein; he shall also collect the town
taxes, and have power to distrain and sell therefor in like
manner as a county treasurer may distrain and sell for State
taxes.
6. The council of said town shall elect one of their own
number a treasurer, and shall require of bim a bond ina
penalty of one thousand dollars, with good security, to ac-
count for all moneys coming to his hands as such treasurer:
who shall also act as clerk for gaid board, and keep a record
of the proceedings of said council, and ot all ordinances and
by-laws passed by the same. ‘They shall also require a like
bond of the sergeant, payable to suid town, and conditioned
for the faithful perfor mance of his duties as such sergeant.
§7. The trustees of said town shall be elected by the elec-
tors of said town in the manner prescribed by law, and if at
any election there be a tie vote for a councilman or trustee,
then the judges of election shall determine by lot which of
the said candidates shall be elected. The time for holding
the first election forsaid trustees, agreeably to the provisions
of this act, shall be on the second Thursday in June, eighteen
hundred and eighty-seven, and biennially thereafter on the
second Thursday in June. The said trustees so elected, shall
enter on the duties of their offices on the first day of July
succeeding their election. The council of said town shall, at
its first meeting hereunder, appoint three judges of clection
to conduct the first election hereunder, and biennially there-
after, in the months of April or May, the said council shall
appoint judges of elections for said town.
2. This act shall be in force from its passage.
