Chap. 10.—An ACT to authorize the town of Farmville to vote a
subscription to the Farmville and Powhatan railroad company, and
to amend and re-enact section 6, chapter 200, Acts of mbly,
1885-6.

Whereas the courties of Powhatan and Cumberland were
authorized by an act of the legislature approved February
fifth, eightcen hundred and eighty -8ix, to vote a subscription
to the Farmville and Powhatan railroad company; and
whereas it is intended that said road shall run through the
town of Farmville; tberefore,
1. Be it enacted by the veneral assembly of Virginia, That
the town of Farmville be and is hereby authorized to sub-
scribe fifty thousand dollars of the stock of the Farmville
and Powhatan railroad company, and the council of said town
in their discretion shall cause a vote of the qualified voters of
said town to be taken in the manner prescribed by law, and
if three-fifths of said qualified voters of said town voting at
said election are in favor of such subscription, and said three-
fifths shall include a majority of the frecholders voting at said
election, then the council of said town may issue bonds for
said subscription, upon such conditions, in such forms, run-
ning for such length of time, in such sums. payable at such
periods and places, and bearing such rate of interest, not
exceeding six per centum, as suid council may determine.
2. That the council of said town are hereby authorized and
required to levy and collect a tax sufficient to pay the inter-
est on said bonds, and to create a sinking fund to pay the
principal of the same when they shall become due.
3. That section six of chapter two hundred of Acts of
Assembly, eighteen hundred and cighty-five-six, be amended
and re-enacted so as to read as follows:
§ 6. The counties of Cumberland, Prince Hdward, and
Powhatan, or any incorporated town or city, except the town
of Farmville, along or near this railroad or at any terminal
point thereof, or along or near the line of its branch, lateral
or connecting lines, or at their terminal points, may subscribe
to the capital stock of said company; and to this end it shall
be the duty of the county court of such county, and the hus-
tings court of such city or town, in its discretion, tOe cause a
vote of the qualified voters of such county, city or town to
be taken at such time and for such amount as the president
and board of directors of said Farmville and Staunton river
railroad company may request. Notice of said election shall
be given in accordance with section sixty-one of the Code of
eighteen hundred and seventy-three. If it uppears by the
returns thereof, that three-tiftbs of the qualified voters voting
upon the question, which shall include a majority of tbe free-
holders voting upon the question In any city, county or town,
are in favor of such subscription, the same shall be made,.and
thereupon the county, hustings or corporation court of such
county, city or town, shall make all necessary orders for the
issuing and delivery to the said company, the bonds of such
county, city or town to the amount of subscription so made,
and payable at such times and places, and in such sums, with
interest at a rate not exceeding six per centum per annum, as
sucb court may determine; and said bonds shall be received
at par in payment of said subscription. Said court in order-
ing said vote, may, in its discretion, require the whole or any
part of said subscription to be expended in the county making
the same. The supervisors of any county making a subscrip-
tion under the provisions of this act, are authorized and re-
quired to levy and collect a tax sufficient to pay the interest
and provide a sinking fund to liquidate the principal of said
bonds when due: provided that the county of Prince Edward,
excluding the town of Farmville. shall not subscribe more
than fitty thousand dollars to said capital stock.
4. This act shall be in force from its passage.
