Chap. 90.—An ACT to authorize the Radford Land and Improvement
company to erect a dam across New river.
Approved February 3, 1888.
1. Be it enacted by the general assembly of Virginia, That |
the Radford Land and — company is hereby
authorized and empowered to erect a dam or dams across the
New river, at any point or points within two miles of the
New river depot, and to divert therefrom so much of the
water thereof as may be required to supply water power or
water to any town, mills, factories, or other establishments
which may be erected or established at or near Radford, New
river depot, and other points on or near the New river within
two miles of New river depot, with full power to erect,
maintain, and operate the same, with all the necessary sluices,
locks, race-ways, and other appliances: provided that when.
damage may arise to land from the overflow of water or
otherwise from the erection of said dam, the individuals
whose property may be injured thereby shall be entitled for
such injury to such damages asa jury may assess in the
manner now prescribed by law in such cases: provided how- |
ever, that nothing in this act shall be construed to authorize
the said company to erect the said dam on any land not
owned by said company ; and in the erection and maintenance
of said dam, when required by the New River Steamboat
company after the said New River Steamboat company has
provided a steamboat for its purposes ready for operation,
then the said Radford Land Improvement company shall
provide and maintain a suitable lock which will allow the
passage of a boat of the capacity of sixty feet long by fifteen
feet wide.
