Chap. 472.—An ACT to relieve Levi Midkiff, surety of Tyler Midkiff.

Whereas at the January term, eighteen hundred and
eighty-seven, of the county court of Franklin, one Levi Mid-
kiff entered into a recognizance for the sum of one hundred
dollars, as surety for the appearance of one Tyler Midkiff;
and whereas the said Tyler Midkiff failed to appear at March
term, eighteen hundred and eighty-seven, of said court; and
whereas judgment was obtained against said Levi Midkiff
at the March term, eighteen hundred and eighty-seven, for
the sum of one hundred dollars, with interest from that time
and costs; and whereas the said Tyler Midkiff has since been
captured, and is now in jail awaiting his trial; and whereas
as appears from proceedings had in the circuit court of Frank-
lin county, it is proper that the said Levi Midkiff should be
relieved from the said judgment; now therefore,
1. Be it enacted by the general assembly of Virginia, That
the said Levi Midkiff be and hereby is relieved from the said
judgment of one hundred dollars, with interest as aforesaid.
2. This act shall be in force from its passage.
