Chap. 456.—An ACT for the relief of the sureties of John B. Pitzer,
late treasurer of Alleghany county.
Approved March 5, 1888.
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts is hereby directed to release
the sureties of John B. Pitzer, late treasurer of Alleghany
county, from the payment of all damages and interest above
six per centum per annum, on account of the default of the
said John B. Pitzer, treasurer of said county; and the audi-
tor is also directed to give credit to said sureties for any pay-
ments made by the said treasurer and not heretofore credited;
and upon entering judgment in the circuit court for Rich-
mond city, for whatever balance may be found due by saidsure-
ties to the state, whethe1 entered before or after the passage
of this act, no execution shall be issued for the period of four
months; and, if within four months from the date of such
judgment, the said sureties shall pay into the treasury the
principal of said judgment in bonds of the commonwealth,
issued under the act approved February fourteenth, eighteen
hundred and eighty-two, at their face value, the auditor is
directed to endorse said judgment satisfied in full: provided
that if said judgment shall be satisfied by a portion of the
said sureties, the lien of the same shall stand for the benefit
of those who satisfy the same, against the sureties not con-
tributing to the extent of their contributive shares respect-
ively: and provided further, that the lien of said judgment
shall stand as against the said John B. Pitzer, for the benefit
of the sureties 80 paying as aforesaid: and provided further,
that the provisions of this act shall be inoperative until all
of said sureties, living in this state, shall file their written
assent thereto with the auditor of public accounts: and pro-
vided further, that nothing in this act shall relieve the said
John B. Pitzer from any part of his liability to the common-
wealth for interest, damages, and costs, according to law.
