Chap. 429.—An ACT for the relief of the sureties of C. H. Ingles, late
treasurer of Henry county.

Whereas two several judgments were recovered on the
twenty-sixth day of May, eighteen hundred and eighty-seven,
in the circuit court ot the city of Richmond by the common-
wealth of Virginia against C. H. Ingles, late treasurer of the
county of Henry, and his sureties on his official bonds as
treasurer as aforcsaid—that is to say, one judgment against
C. H. Ingles, treasurer as aforesaid, for the sum of three
thousand four hundred and fifty dollars and twenty-two cents
on account of balance due the state on the revenues of the
year eighteen hundred and seventy-eight, with six per cen-
tum interest on twenty-one dollars and sixty-three cents, part
thereof, from the fifteenth day of May, eighteen hundred and
seventy-nine, until paid, and with like interest on three thou-
sand four hundred and twenty-eight dollars and fifty-nine
cents, residue thereof from the fifteenth day of June, eigh-
teen hundred and seventy-nine, and eight dollars and sixty-
four cents costs; and against R. C. Wells, J. W. Johnston, O.
M. Allen, H. B. Eans, P. W. Stultz, Abner Richardson, G. J.
Minter, George Eggleton, J. D. Trent, Hardin Price, W. 8.
Minter, F. C. Gravely, J. H. Martin, R. W. Edwards, W. J.
Griggs, L. P. Richardson, P. Hairston, Daniel Shumate, 8. D.
Gravely, 'T. O. Martin, B. W. L. Philpott, George L. Richard-
son and H. J. Winn, sureties as aforesaid, for the sum of three
thousand four hundred and fifty dollars and twenty-two cents,
balance due on account of revenues of the year eighteen hun-
dred and seventy-eight, with six per centum interest thereon
from the twenty-sixth day of May, eighteen hundred and
eighty-seven, until paid, and thirteen dollars and seventy-five
cents costs; and another judgment against said C. H. Ingles,
treasurer as aforesaid, for three hundred and sixty-four dol-
lars and twenty-nine cents, with six per centum interest
thereon from the first day of June, eighteen hundred and
seventy-seven, and nine dollars and twenty-tour cents costs;
and against James S. Redd, Henderson Phillips, S. 8. Fret-
well, George Eggleton, Sol Franklin, Peyton W. Stultz, S.
Stanly, William J. Griggs, P. Hairston, Hardin Price, Abner
Richardson, S. Minter, John H. Davis, George W. Hundley,
Benjamin F. Dyer, William Finney, Daniel Sumate, B. W.
L. Philpott, J. KE. Atkinson, John A. Hardie and 8. M. Doyle,
sureties as aforesaid, for the sum of three hundred and sixty-
four dollars and twenty-nine cents, with interest thereon at
the rate of six per centum from the twenty-sixth day of May,
eighteen hundred and eighty-seven, and twelve dollars and
twenty-five cents costs; and whereas the sureties as aforesaid
had no notice of the defalcation aforesaid, until the year eigh-
teen hundred and eighty-six, and therefore no opportunity to
pay before that time the amounts aforesaid; and whereas,
etween the date of the defalcation aforesaid and the date of

the said notice, many of said sureties had died, and many,
solvent at the date of said defalcation, had become insolvent,
and the burden of paying the amount which will have to be
paid by said sureties will fall upon comparatively a few of
them; and whereas the said C. H. Ingles has conveyed his
property to John H. Pharis, trustee, in trust to indemnify
and save harmless his sureties, but the same will be largely
inadequate therefor; now therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby authorized
and required to accept from said sureties, bonds of the state
of Virginia, commonly known as Riddleberger bonds, at their
par or face value, in bar of any proceeding against said sure-
ties to the extent of said par value: provided that nothing
herein contained shall be construed to discharge the said C.
H. Ingles from the payment of the full amount of the said
judgments which shall be credited as to him, with only the
amount actually paid for said bonds: and provided also, that
the said sureties shall be liable as amongst themselves for
contribution according to the amounts paid by them: and
provided also, that the bonds aforesaid shall be delivered to
tbe said auditor within twelve months from the time this act
takes effect.
2. This act shall be in force from its passage.
