Chap. 408.—An ACT to allow the qualified voters of Dranesville dis-
trict in the county of Fairfax, to vote on the question of continuing
or repealing the present fence law.
Approved March 5, 1888.
1. Be it enacted by the general assembly of Virginia, That.
at the election to be held on the fourth Thursday in May,
eighteen hundred and eighty-nine, the qualified voters of
Draneaville district, Fairfax county, be allowed to vote upon
the question of continuing or repealing the present fence law
in said district.
2. The manner of depositing the ballots and opening and
canvassing the same, and making return and abstract thereof,
shall conform in all respects to the requirements of the gene-
ral election laws of the state, except that the certificate of the
judges of election shall be as follows: We hereby certify that
at the election held » —— votes were cast for the pre-
sent fence law, and votes were cast against present
fence law.
3. Voters residing within the corporate limits of the town.
of Herndon, shall not be entitled to vote on the said question:
provided, that this section shall not apply to such of said
voters as own land in said district, lying outside of said cor-
porate limits.
4. If it shall appear from the abstract and returns of said |
election, that a majority of the qualified voters of said district:
voting upon the question, and said majority include a majority
of the registered voters in said district who are entitled to
vote on said question, according to the provisions of section
three, are against the present fence law, then it shall be the
duty of the judge of said county, to declare all acts or orders

creating or defining a fence law in said district, repealed and
rescinded: provided however, that the laws and ordinances
at present in force in the said town of Herndon, shall not be
altered or in any way affected by the result of said election:
,and provided further, that after said repeal takes effect, the
boundary line of said lot or tract of land within said district
shall be and is hereby declared a lawful fence, and all rights
and remedies in regard to trespass of animals, shall be secured
and governed by tbe general laws in force at the time of said
election, in regard to those portions of the state where the
boundary lines of land constitute a fence.
5. This act shall be in force from its passage.
