Chap. 252.—An ACT to amend and re-enact sections 3 and 6 of an act
entitled an act to incorporate the Martinsburg and Potomac railroad
company, approved July 9, 1870.
Approved February 24, 1888.
1. Be it enacted by the general assembly of Virginia, That
sections three and six of an act entitled an act to incorpo-
rate the Martinsburg and Potomac railroad company,
approved July ninth, eighteen hundred and seventy, be
amended and re-enacted so as to read as follows:
§3. The company hereby incorporated shall have full right.
and privilege, and is hereby authorized and empowered to
intersect or connect with any other railroad at such point or
points as it may deem proper and advisable; and also to make
such leases or sales of the entire road-bed and corporate fran-
chises, or any part thereof, as to said company may seem
desirable: provided that no such connection or leases shall
be made, or any arrangements entered into, in pursuance
thereof, which shall not bein accordance with the general
provisions of the Code of Virginia, applicable to internal
improvement companies: provided, that if any corporation |
of any other state shall, pursuant to the provisions of this.
act, become the purchaser or the lessce of the works, prop-
erty, and franchises of the corporation hereby created, such
purchaser or lessee shall ipso facto become and be a corpora-
tion of this state, and shall and may have, use, exercise, and
enjoy all the rights, a and privileges of the corporation
hereby created, and be subject to all the duties and liabilities
imposed upon the same by its charter and the general laws
of the state: and provided further, that all taxes and other
dues due to the state of Virginia by said company or com-
panies, shall be paid in the currency of the United States,
and not in coupons.
§6. Such organization of the said company as shall have.
been heretofore effected under authority of an act of the’
legislature of West Virginia, passed nineteenth February,
eighteen hundred and sixty-eight, and the amendment thereto |
passed February twenty-eighth, eighteen hundred and sev-
enty, is hereby confirmed and assented to, so far as the same
is not inconsistent with this act, and the provisions of the
Code of Virginia applicable to internal improvement compa-
nies. And it is hereby declared to have been the object and
intent of the general assembly in confirming and assenting
to the act of the West Virginia legislature, to enact in the
chapter two hundred and fifty-one, acts eighteen hundred
and sixty-nine-seventy, all of the provisions of said act as
fally and effectively as though the same had been in terms
set forth in the body of said chapter two hundred and fifty-
one, and therein expressly enacted.
2. This act shall be in force from its passage.
