Chap. 233.—An ACT to amend and re-enact section 10 of an act in
force February 23, 1882, entitled an act to incorporate the Virginia
ad Selon railroad company, amended by an act approved ch
6, 1886.
Approved February 24, 1888.
1. Be it enacted by the general assembly of Virginia, That
section ten of the act in force February twenty-first, eighteen
hundred and eighty-two, to incorporate the Virginia and
Carolina railroad company, which was amendéd by an act
approved March six, eighteen hundred and eighty-six, be
amended and re-enacted so as to read as follows:
§10. The said Virginia and Carolina railroad company
shall commence the work under this bill within two years,
and complete the same within three years from the first of
January, eighteen hundred and eighty-eight. But provided
that in case there be an order af” sale of the property and
franchises of the said railroad company in the suit now pend-
ing in the chancery court of the city of Richmond, between
the city of Petersburg, plaintiff, and the said Virginia and
Carolina railroad company and other defendants, the pur-
chasers at said sale shall, within twelve months after the final
confirmation of said sale, and the turning over to them of
the said property and franchises, complete, equip, and put in
operation twenty miles of the said railroad; and shall, within
two years after the said final confirmation of sale and turn-
ing over of the said property and franchises, complete, equip,
and put in operation thirty miles in addition of the said rail-
road; and shall, within three years after the said final con-
firmation of sale and turning over of the said property and
franchises, complete, equip, and have in operation at least so
much of the said railroad as extends from the North Caro-
lina line to the city of Petersburg: and provided further,
that a failure to comply with said conditions, or either of

them, shall work a forfeiture of this charter; but no prop-
erty, rights of any person or persons, except as to the fran-
chises granted said company, shall be forfeited by this pro-
vision, but the same shall be, remain, and exist just as they
were immediately before the date of the forfeiture above pro-
vided for.
2. This act shall be in force from its passage.
