Chap. 98.—An ACT to authorize the board of supervisors of the
county of Fluvanna to establish a free ferry across the Rivanna
river. .
Approved February 8, 1886.
1. Be it-enacted by the general assembly of Virginia, That
the board of supervisors of the county of Fluvanna, a majority
of said board being present and concurring, is hereby author-
ized and empowered to establish a public free ferry across the
Rivanna river, at a point known as the Moss and Gravel, and
to that end shall have power to lease or purchase, or if that be
not practicable, to condemn, aecording to the provisions of ex-
isting laws in relation to condemnations of land for public
roads or landings by the court, so much land on either side of
said river as may be necessary for the objects and purposes of
this act.
2. Should said board determine to establish said ferry, it
will then be authorized to employ a keeper thereof on the
most economical terms they may be able, to build for hima
house upon said land, and to purchase and supply all boats
and other things needful for the convenience and safe opera-
tions of said ferry.
3. The keeper of said ferry shall be required, either in per-
son or by some one to be employed by him for the purpose,
to convey and carry across said river, free of charge, all resi-
dents of said county, together with all animals, vehicles, and
so forth, belonging to them, in the order of their arrival in or
in the order of their application therefor; all other than resi-
dents of said county shall pay to said keeper, or his agent,
five cents per head for persons and horses, and three cents per
head for all animals other than. horses, and three cents per
wheel for all vehicles carried across said ferry; of which sums
so paid him the said keeper of the ferry shall be required to
render annually to said board a careful and strict account.
4. Should said ferry be established, the said board of super-
visors is hereby authorized and required, at the usual time of
levying the county levy, to levy upon all property now taxa-
ble in the county for an amount sufficient to cover all expenses
incurred in the establishment and carrying on of said ferry.
5. Said board shall take of the keeper of the ferry bond,
with good security, in the penalty of three hundred dollars,
payable to the said board of supervisors, and conditioned for
the faithful performance of his duties under this act. Said
bond shall be by said board reported to the county court of
said county, and be filed by the clerk thereof among the rec-
ords of the court.
6. The bond aforesaid may be put in suit for a breach of any
of its conditions, in the name of said board of supervisors, but
at the cost, and for the benefit of the person aggrieved, and
shall not be ineffectual by reason of the first recovery thereon,
but may be sued on from time to time until the whole penalty
thereof shall have been recovered.
7. Said board shall have power, by the concurrence of a
like majority thereof, to remove said ferry to any other point
on said river in the neighborhood of that named, if such re-
moval shall be deemed by them more conducive to the public
convenience, the said board being invested with the same
power and authority with reference thereto as to the ferry first
proposed to be established by this act.
8. This act shall be in force from its passage.
