Chap. 92.—An ACT to release the interest of the State of Virginia,
in and to a certain lot (No. 738) in the plan of the City of Richmond,
and appointing trustees for that purpose. )

Whereas, by an act of the general assembly, passed Febru-
ary twenty-third, eighteen hundred and eighteen, P. N. Nicho-
las, William B. Chamberlayne and John Robertson (any two
of whom were empowered to act) were appointed trustees, for
the purpose of selling for cash, or upon credit, certain real es-
tate, formerly owned by Patrick Coutts, and which escheated
to the commonwealth; and whereas, P. N. Nicholas and Wil-
lam B, Chamberlayne, two of the trustees aforesaid, sold that
certain lot, number seven hundred and thirty-eight, in the plan
of the city of Richmond, to Samuel Mordecai, for one thous-
and six hundred and twenty-five dollars, payable in three equal
instalments, at one, two and three years after date, and con-
veyed the said lot by deed, dated the fifth day of April, eigh-
teen hundred and nineteen, recorded in the hustings court of
the city of Richmond, deed-book fifteen, page six hundred and
twelve; and whereas, by deed of even date with the above
deed, recorded as above, deed-book fifteen, page six hundred
and thirty-three, Samuel Mordecai conveyed said lot to said P.
N. Nicholas and William B. Chamberlayne, trustees, to secure
the said one thousand six hundred and twenty-five dollars, pur-
chase money, payable as above; and whereas, a presumption
of payment arises from the great lapse of time; and whereas,
the parties now in possession of said lot, and those under whom
they claim, are purchasers for value, and have been in continu-
ous and undisputed possession thereof for over sixty years; and
whereas the said trustees above mentioned are now dead; now,
therefore, ;
1. Be it enacted by the general assembly of Virginia, That
Tazewell Ellett and Frank H. McGuire of Richmond, Virgi-
nia, are hereby appointed trustees, in place of P. N. Nicholas
and William B. Chamberlayne, trustees, deceased, and are
hereby authorized, empowered and instructed, to release, by
proper deed, to the present owners of lot number seven hun-
dred and thirty-eight, in the plan of the city of Richmond, all
right, title, claim or interest of the state of Virginia, in and to
said lot.
2. This act shall be in force from its passge.
