Chap. 461.—An ACT to allow William H. Ash to establish a ferry
from Gloucester Point to Yorktown, and from Yorktown to Glou-
cester Point, across York river.
Approved March 6, 1886.
Whereas W. H. Ash, of the county of Gloucester, has been
operating: a ferry between Yorktown, in the county of York,
and Gloucester Point, in the county of Gloucester, under an act
of the House of Burgesses, and also under proceeding in the
county court of Gloucester county, in the year eighteen hun-
dred and sixty-seven to the present time; and whereas there
is some doubt as to whether the said ferry was discontinued
during the occupation of Yorktown by the Federal army, from
May, eighteen hundred and sixty-two, to the end of the war,
in eighteen hundred and sixty-five: therefore,
1. Be it enacted by the general assembly of Virginia, That:
it shall be lawful for said William H. Ash to keep the said ferry
across the York river, between the point at Yorktown and the
point at Gloucester Point, between which the said ferry has
been operated bv him since March, eighteen hundred and sixty-
seven, and to charge such rates of ferriage as were adopted by
the said county court of Gloucester county at the March term
thereof, eighteen hundred and sixty-seven, unless the county
courts of the said counties, after due proceedings in said courts,
shall change the said rates.
2. The ferry hereby authorized to be established shall be
subect to all the rules, regulations, conditions and penalties
prescribed by the general statutes now in force, or hereafter
enacted, governing fermies established under the provisions of
chapter sixty-four, of the Code of eighteen hundred and seventy-
three, and the proprietors of such ferry shall be entitled to all
of the rights, privileges and remedies given as such under said
statutes, and for all purposes, the said ferry shall be deemed to
have been established under the provisions of said chapter of
said Code: provided, however, that the franchise hereby granted
shall also, at all times, be subject to the control of the general
assembly, and may be at any time revoked by it.
3. This act shall be in force from its passage.
