CHAP. 452.—An ACT to amend and re-enact an act entitled an act to
amend section 10, chapter 17, Code of 1873, in relation to the sus-
pension and removal of certain officers, in force February 23, 1884.
Approved March 6, 1886.
1. Be it enacted by the general assembly of Virginia, That
an act entitled an act to amend section ten, chapter seventeen,
Code of eighteen hundred and seventy-three, in relation to the
suspension and removal of certain officers, in force February
twenty-third, eighteen hundred and eighty-four, be amended
and re-enacted so as to read as follows:
§ 10. Any of the said officers may be removed from office by
joint vote of both houses of the general assembly, or during the
recess of the general assembly may be removed or suspended
by the governor. This power shall be exercised by the gover-
nor for misbehavior, incapacity, neglect of official duty, or acts
performed without due authority of law. And in any case in
which the power may be so exercised by the governor, he shall
fill the office vacated by a temporary appointment, and shall
immediately after the commencement of the next session of the
general assembly report to the assembly the fact of the re-
moval or suspension, and the cause thereof.
2. This act shall be in force from date of passage.
