CHAP. 427.—An ACT regulating ferries, with relation to the town of
Mercer Ferry, near Fredericksburg.
Approved March 6, 1886.
Whereas it is represented to the general assembly, that the
facilities for crossing the Rappahannock river near Fredericks-
burg are such as to render it inconvenient and unnecessary for
the proprietor of the lower or Mercer ferry to continue the same
at present, there being two bridges across said river at or near
Fredericksburg, but that in case of the interruption or discon-
tinuance of other existing facilities, the revival of said ferry
would be expedient; and whereas under the operations of the
general law, the disuse of a ferry for a certain time produces a
forfeiture by the proprietor of his right to continue the same.
1. Be it enacted, that the provisions contained in the eleventh
section, of chapter sixty-four, of the Code of eighteen hundred
and seventy-three, shall be and are hereby suspended with re-
lation to the ferry across the Rappahannock river, near the
town of Fredericksburg, known by the name of the lower or
Mercer ferry; and the proprietor may discontinue the said ferry
until he shall think proper to put it again in operation: pro-
vided, however, that the said ferry shall be re-opened at any
time the bridge belonging to the said Scott shall be under re-
pairs or not passable.
2. This act shall be in force from its passage.
