Chap. 412.—An ACT to amend and re-enact chapter 24, Acts of
1874, approved February 2, 1874, entitled an act to incorporate the
town of Banister, in the county of Halifax, and to amend and re-
enact chapter 102, Acts 1874, approved March 14, 1874, entitled an
act to authorize the trustees of the town of Banister to elect a presi-
dent and town sergeant &c.

1. Be it enacted by the general assembly of Virginia, That
the town of Banister, in the county of Halifax, as the same has
heretofore been or may hereafter be laid off into lots, streets
and alleys, and within the foliowing boundaries: beginning at a
rock on the top of the high hill on the north side of Foot’s creek,
nearest the court-house; thence north twelve and one-third de-
grees, east ninety poles, seventeen links, to a pine in a grave-
yard; thence north twenty-seven and one-quarter degrees, east
one hundred and two poles to a pine at Mrs. M. W. More’s
stable lot; thence north twenty-five and one-third degrees, east
twenty-seven poles to red oak in old Methodist church lot;
thence north thirty-one and one-third degrees, east seventy-two
poles to a pine; thence north thirty-seven degrees, east fifty-
three poles to a cedar at the corner; thence across the bridge
road north seventy-two and one-half degrees, west twenty-six
poles to a pear tree; thence south sixty-five and one-half de-
grees, west fifty-eight poles to a cherry tree; thence south forty-
one and one-fourth degrees, west one hundred and twelve poles
to an apple tree; thence north seventy four degrees, west forty-
two poles to a white oak; thence south twenty-two and, one-
quarter degrees, west. twenty-eight poles to a rock; thence
north seventy-four and one-half degrees, west seventy-one
poles to northwest corner of Willingham’s lot; thence south
forty-seven degrees, west thirty six and one-half poles to pines
in woods; thence south fifty and one-half degrees, west forty-
eight poles to Pointer’s; thence south sixty-three degrees, west
twenty-four poles to post; thence south five and one-half de-
grees, east thirty-seven poles to N. T. Green’s stable; thence
south nine and three-quarter degrees, ‘west thirteen poles to a
cedar; thence south sixty-five degrees, east two hundred and
twenty-five and one-half poles to beginning; shall be and the
same is hereby made a town corporate by the name of Banis-
ter, and by that name shall have and exercise the powers con-
ferred upon towns by the fifty-fourth chapter of the Code of
Virginia, edition of eighteen hundred and seventy-three, and be
subject to all the provisions of said Code, and to all laws now
in force or which may hereafter be enacted in reference to the
government of towns of less than five thousand inhabitants, so
far as the same are not inconsistent with the provisions of this
act.
§ 2. Be it further enacted, That R. W. Watkins, N. T.
Green, W. A. Rogers, R. H. Edmondson, R. H. Easley, W.
N. Dickens, B. M. Estes and J. S. Easley shall constitute the
board of trustees of said town, and in them and their success-
ors the government of said town shall be vested.
§ 3. That the trustees aforesaid shall, upon taking the oath
prescribed by law, enter upon the duties of their offices, and
may elect one of their number president who shall act as
mayor of the said town till the regular election in May, eigh-
teen hundred and eighty-six; and the said board may elect a
town sergeant, who shall act as such until his successor is elected
and qualified.
2. This act shall be in force from its passage.
