CHAP. 408.—An ACT to prescribe a condition precedent to the hiring
of penitentiary convicts to the Danville and New River railroad
company.
Approved March 3, 1886.
1. Be it enacted by the general assembly of Virginia, That
upon the application of the Danville and New River railroad
company to the governor, superintendent of the penitentiary,
or any other officer authorized ‘by law to hire on the part of the
commonwealth the convicts confined in the penitentiary, for the
hire of such convicts, to be used in the extension of said road
west of the town of Stuart, in the county of Patrick, it shall
be the duty of the governor, superintendent of the penitentiary,
or other officer empowered as aforesaid, to require of such com-
pany, as a condition precedent to the hire as aforesaid, that it
shall, by its duly constituted agents, execute a valid, effectual
and legal release of the subscription of fifty thousand dollars to
be expended in such extension, heretofore voted by Patrick
county, and all liabilities resting upon Patrick county on ac-
count of the same.
2. Upon the execution of such release it shall be submitted
to the attorney-general for his approval, and if he shall approve
such release as valid, effectual and legal, then a contract or con-
tracts for such hiring may be executed on the terms provided
by law; but no such contract shall be made, or contract fur-
nished, until the attorney-general shall have endorsed in writing
on such release his approval thereof, as above prescribed.
3. This act shall be in force from its passage.
