Chap. 366.—An ACT for the relief of clerks, banks, &c.
Approved March 3, 1886.
Whereas, the special committee appointed by the house of
delegates, in pursuance of a resolution adopted November
twenty-ninth, eighteen hundred and eighty-four, to investigate
affairs in the office of the auditor of public accounts, have re-
turned with their report a book entitled, Special Settlements
with clerks of courts, banks and others (reference to which is
made in said report as two books), in which are stated the ac-
counts of clerks of courts, from September first, eighteen hun-
dred and seventy-six, to September first, eighteen hundred and
eighty-three, except a few, which embrace years prior to Sep-
tember first, eighteen hundred and seventy-six; and banks,
from eighteen hundred and seventy-one, to eighteen hundred
and eighty-four, with the commonwealth; which said book is
the only full record by which said accounts for said years are
shown; therefore,
1. Be it enacted by the general assembly of Virginia, That
the said book shall be made and is hereby made a part of the
records of the office of the auditor of public accounts, so far
as it shows a complete statement of the accounts therein em-
braced; and all the amounts set forth in the second column of
the accounts, set out in said books as payments made in the
auditor’s office by check, money, or claims against the com-
monwealth, are hereby declared payments, and the parties en-
titled to credit for the same.
2. The balance due from said clerks and banks, after allowing
credit for the amount appearing in said second column, shall
be the basis of further settlement with the parties appearing to
be indebted to the commonwealth; and the said clerks and
banks shall be entitled to credit for such further payments as
they may show were made in like manner with those allowed.
3. The auditor of public accounts is hereby authorized to
settle with clerks of courts, banks and others, appearing to be
in default, upon the principle of this act; but nothing in this
act shall be construed to debar the state from collecting claims
against clerks, banks or others, for which checks were sent to
the auditor of public accounts, and which checks remain un-
paid.
4. This act shall be in force from its passage.
