Chap. 346.—An ACT to create a commission to ascertain and settle
the true boundary line between the counties of Alleghany, in the
state of Virginia, and Monroe, in the state of West Virginia, and to
prescribe the powers and duties thereof.
Approved March 1, 1886.
Whereas the true line between the counties of Alleghany, in
this state, and Monroe, in the state of West Viginia has not
been ascertained and settled under any law now in force, anda
dispute has arisen in relation thereto; and whereas it is the de-
sire of the proper authorities of each of said counties that that
part of said line which is in dispute shall be accurately located
and marked, therefore,
1. Be it enacted by the general assembly of Virginia, That
Thomas Carter, Samuel A. Damron, Andrew A. Kean, John
W. Vawter and A. W. Cooke, any three or more of whom may
act, be and they are hereby appointed commissioners, with power
to act in conjunction with a similar commission, or any lawfully
authorized authority appointed by the county court of said
county of Monroe, and to ascertain and establish the true line
between said counties. .
2. Said commissioners, ‘before proceeding to ascertain such
boundary, shall employ a competent surveyor and chain-carriers
torunthesame. Said surveyor shall make a plat of the course
or courses and distances of the said line, and note particularly
such objects of prominence or places of notoriety, through or
by which it passes, as in the opinion of a majority of the com-
missioners, will best designate the line. Said surveyor shall
deliver said plat to said commissioners, who shall return the
same to the county court of Alleghany county, there to be re-
corded; and if the proper authorities of said state of West
Virginia, or the county of Monroe, adopt said plat, as repre-
senting the true line between said counties, the said plat shall
be takén as conclusive evidence in all controversies thereafter
touching said line.
3. The.said commissioners shall have power to summon and
examine witnesses, if they deem it proper so to do, and cause
monumients to be placed or erected so as to mark said boundary
line. The county court of Alleghany county shall make a rea-
sonable compensation to the commissioners herein named, and
to the surveyor and chain-carriers, and shall provide for the
costs attending the summoning and examination of witnesses,
including pay for the attendance of witnesses, and shall provide
for the costs attending the placing or erection of said monu-
ments out of the county levy.
4. This act shall be in force from its passage.
