Chap. 303.—An ACT to provide for removing obstructions in Buffalo
and Spring creeks, in Prince Edward county. )
Approved March 1, 1886.
1. Be it enacted by the general assembly of Virginia, That
it shall be laWful for the board of supervisors of Prince Edward
county, Virginia, to impose, levy, and cause to be collected, an
annual tax of not exceeding fifteen cents per acre upon all lands
subject to overflow, lying on either side of Buffalo creek, from
its junction with Appomattox river to Bell’s mill, and upon all
lands subject to overflow lying on either side of Spring creek,
and on either side of the north fork of said Spring creek, up to
Womack’s mill, and to apply said tax to the purpose of clean-
ing out and removing obstructions from said streams, along the
lines of the lands so taxed: provided, that such work shall in
no way interfere with dams constructed across said streams by
authority of the courts of said county. :
2. The said board of supervisors shall proceed to divide the
lands so subject to taxation into districts, and to appoint, on
the application of a majority of the land owners in any of said
districts, a suitable person to act as overseer of improvements
in such districts, whose duty it shall be to superintend the im-
provement in said districts, and to collect and expend in such
improvements all taxes levied for that purpose; and he shall
receive for his services one dollar and fifty cents per day, for
each day of actual service; and shall give bond, with such se-
curity, and in such penalty, as the board of supervisors may
direct. The said overseer shall have the powers of a tax col-
lector in collecting the taxes levied under the provisions of this
act.
3. Any person felling trees or putting any obstructions in
said streams, and not removing same within two days after due
notification by the overseer, shall pay a fine of not less than
one nor more than five dollars for each and every offence, on
conviction before a justice of the peace. ,
4. This act shall be in force from its passage.
