Chap. 288.—An ACT authorizing the auditor of public accounts to
allow to S. Russell Smith, treasurer of Culpeper county, credit for
the sum of $64.75, amount of erroneous license tax charged against
him.

Whereas there was assessed by the commissioner of the
revenue for Culpeper county a license tax, for the year eighteen
hundred and eighty and eighty-one, on Edward L. Taylor, for
the sum of sixty-four dollars and seventy-five cents, for the
privilege of selling liquor; and whereas said privilege was
never exercised by the said E. L. Taylor, nor was the tax
collected by the said treasurer, nor could it have been collected;
and whereas the county court of Culpeper, at the February
term, eighteen hundred and eighty-four, entered an order cor-
recting said assessment against the said E. L. Taylor, and
certifying said correction to the auditor of public accounts ;
and whereas more than two years elapsed after the assessment
of said license tax before said order correcting the same was
entered, the auditor of public accounts declined to correct the
same, but required payment of the same by the said treasurer:
therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby authorized
and directed, in his future settlements with said treasurer, to
allow him a credit for the sum of sixty-four dollars and seventy-
five cents, the amount of license tax so erroneously assessed.
2. This act shall be in force from its passage.
