Chap. 283.—An ACT to amend and re-enact section 3 of an act
for the: protection of game, approved March 29, 1877, as amended
by an act approved March 3, 1879, and to amend and re-enact the
8th section of an act for the protection of game, approved March
29, 1877.

1. Be it enacted by the general assembly of Virginia, That
the third section of an act for the protection of game, approved
March twenty-nine, eighteen hundred and seventy-seven, as
amended by an act approved March three, eighteen hundred
and seventy-nine, and the eighth section of an act for the pro-
tion of game, approved March twenty-nine, eighteen hundred
and seventy-seven, be amended and re-enacted, so as to read as
follows:
§ 3. It shall not be lawful to kill any wild water-fowl in this
state between the first day of May and the first day of Septem-
ber of each year, or during the night at any time, that is, be-
tween dark and daybreak; nor shall it be lawful to capture any
wild water-fowl in traps, nets, or any other contrivances, at any
time, except the wild water-fowl commonly called the summer
duck, which summer duck shall not at any time be captured in
any of the modes above named, and except the wild fowl com-
monly called sora; nor shall it be lawful to kill wild water-fowl
except with a gun that can be raised at arms’ length and fired
from the shoulder without a rest. Wild geese may be killed
either during the day or night: provided, that in no case shall
floating reflectors or lamps be used in shooting wild geese in
the night time.
8. Any person offending against the provisions of this act
shall be guilty of a misdemeanor, and on conviction thereof in
anv court, or before a justice of the peace, shall be fined ten
dollars for each offence, and shall be imprisoned until said fine
is paid, but not exceeding thirty days. The possession of any
prohibited bird or deer within the prohibited period mentioned
in this act, shall be held as prima facie evidence of its viola-
tion, and subject the person in possession to its penalties: pro-
vided, that as to all violations of the third section of this act,
as above amended, the fine shall be twenty dollars for each
offence, one-half to go to the informer, and in all other respects
the law shall apply as above: and provided further, that all
violations of the third section of this act, as above amended,
in reference to traps, nets, and other contrivances, the party or
parties thus offending shall forfeit all such appliances and pay a
fine of one hundred dollars, one-half to go to the informer, or
shall be imprisoned until said fine is paid, but not exceeding
ninety days; said fines to be recovered in the mode and man-
ner as prescribed in this act.
2. This act shall be in force from its passage.
