Chap. 282.—An ACT for the relief of James M. Binford, treasurer of
the city of Portsmouth.
Approved March 1, 1886.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for James M. Binford, treasurer of the city of
Portsmouth, to collect by levy, or otherwise, as if the same
were executions in the hands of the sergeant of said city, all
tax-bills assessed for the years of eighteen hundred and eighty-
two and eighteen hundred and eighty-three, in said city, and
which were not returned delinquent: provided, however, that
the right of said treasurer to levy for the said tax-bills shall not
continue beyond one year from the date of the passage of this
act.
2. Be it further enacted, that upon the production of evidence
satisfactory to the auditor of public accounts, that school-war-
rant number eighty-one, for three thousand five hundred and
twenty-one dollars and five cents, dated December nineteenth,
eighteen hundred and eighty-four, for the city of Portsmouth,
has been lost by the treasurer of said city, and that the amount
of said warrant has been paid in full by said treasurer, upon
orders of the proper school authorities of said city, the said
auditor is hereby authorized to credit said treasurer with the
same: provided, that the auditor shall take from the said treas-
urer a bond of indemnity, with proper security, for four thou-
sand dollars, to save the commonwealth harmless.
3. Be it further enacted, that it appearing from the bank
book of the said James M. Binford, treasurer, that there was
deposited to his credit, as treasurer of the city of Portsmouth,
on the second of April, eighteen bundred and eighty-five, in
the banking house of Bain and Brother, in said city, the sum
of six hundred dollars .of funds belonging to the state, which
bank failed on said day, the auditor of public accounts is hereby
authorized and directed upon the delivery to him by the said
treasurer of his bank book aforesaid, to credit the account of
the said treasurer with the sum of six hundred dollars, or such
sum as appears therefrom to be due on the said bank book, as
if the same had been paid on the second day of April, eighteen
hundred and eighty-five, and the said auditor shall collect from
the said bank, and pay into the state treasury, such sums as may
be paid by the receivers or trustees of said bank on account of
said deposit.
4. This act shall be in force from its passage.
